    Send VCS a SAR and a copy of the proof that his landlord actually owns the space and that it is excluded from enforcement on that basis, as the landlord has never agreed to vary his lease?

    I have started writing the SAR using the legal beagles template. Is there anything else I should include in it other than what the NEWBIES thread suggests?

    Also, what should I send specifically as proof? I have a copy of the lease for the space but I thought I shouldn't "show my hand" as it were at this stage?

    Stick with what is said in the Newbies, written by professionals who know what they are talking about.

    You need to let VCS know that you know more than they do
  • Can someone please check the following SAR to see if it is appropriate:

    "Dear Sir or Madam

    Subject access request ( Data Protection Act 2018 / General Data Protection Regulations (GDPR) )

    I am writing to request that you please supply the data about me that I am entitled to under data protection law relating to myself.

    Specifically, I request that you supply the following:

    - all photos taken pertaining to me or any property of which I am a leaseholder.
    - a close up of the signs on the day in question.
    - evidence that Vehicle Control Services LTD has paid a debt collector if relevant.
    - all letters/emails sent and received, including any appeal correspondence earlier.
    - all data held, all evidence they will VCS LTD will rely on in any future hearing and a full copy of the PCN and Notice To Keeper.
    - and a list of all PCNs that VCS LTD considers to be outstanding against me.

    If you need any more data from me to confirm my identity please let me know as soon as possible. It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month. However, I am minded to remind you that as you have recently sent me a Letter Before Claim you already hold required identification and should not require anything more.

    If you do not normally deal with these requests, please pass this letter to your Data Protection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.

  • My landlord is refusing to give me written confirmation that I can use the parking space incase it goes to court and she gets into trouble.

    There is a letting agent though, could they write three letter for me?

    Tell could your landlord that she will be required to attend court as a witness if she doesn't provide you with the proof of ownership you need.

    You could also obtain the necessary information about land ownership from the Land Registry for a few quid.

    It depends entirely on what it says about the parking space. If it is included in the wording of lease, and/or her ownership is shown on a Land Registry entry, then you have the proof you need.

    If she hasn't given her permission to the scammers to operate a for profit business on her land, it is the PPC and the MA that will be in trouble if it goes to court, not her.

  • Right I could do with some help. I need to respond to the LBC I got from VCS as soon as possible.

    I am going to tell them to cease and desist with their claim. Can someone help with the wording with this please? Also, I have a copy of the lease of the actual parking space that has my Landlord's name on it and it's obviously a long document. Shall I send a copy of the whole document? Or just relevant parts? Should I also send a copy of my tenancy agreement with my name and the name of the landlord on it?

  • Ok so I have spoken to the property manager of the management company and he tells me the following:

    "Thank you for your email, My response has not changed and whether I am called as a witness is not an issue. It is important to draw your attention that the shareholders of the RMC appointed the current directors (your landlord is a shareholder), the current directors requested their chosen managing agent to employ a parking enforcement company to enforce the parking regulations of the lease.

    I will let the enforcement company of your thoughts but this is a matter for them and you, as a witness I will be very clear that the shareholders are in favour of the enforcement company and how it manages the car park."

    Can anyone tell me if what he's saying has any legitimacy?
