Hi guys I need some help and advise please. I’ve got 2 pcns one from civil enforcement ltd and 1 from ukpc. I believe I messed it up a little bit already as I had no clue what I’m doing as never had to deal with that before. There is lots of helpful information on the forum but I got so confused after few days going thru all this info on here that I feel like I need your opinion and advise.

1st pcn was issued in may I did appeal that was rejected and then I appealed thru popla and that was also rejected.
That’s what i have wrote to them:

Hello,

My name is ... and I have received a parking charge notice from you pcn no ...

When I entered your car park on 5th of may there was no parking spaces available so I had to wait until one of the cars will leave in order for me to park my car, I had to wait approx 30 minutes to park my car as there was no spaces at all. Eventually one of the cars left and I was able to park my car.

I did make a payment and Im attaching evidence of this which is txt message and also my bank statement

I honestly believe that’s unfair, I have explained to popla that from the moment I entered the car park to the moment I left was still under 1 hour which was was paid anyway ( I know I made a payment to late but I just didn’t realise I should pay while waiting for a space)

Few days ago I received a letter saying I’ve got 14 days to make a payment of £160 or this might be taken to court...

Now I’m getting really anxious about it as I’m worrying that might go to some crazy amount and I really can’t afford to waist money like this.

I will also need some opinion and advise when comes to 2nd pcn I recently got.
I believe this is also all unfair as out of 15 cars parked all over they chooses to only give a pcn to me... that’s the details of my appeal:

This car park is a mess at this moment, it had been under constructions for a while and there is no signs indicating whats happening there. As its under constructions and its not obvious at all if its monitored or not people have no idea what to do and there is cars all over disable bays and outside bays as they working on this at the moment and there is hardly any normal bays ready. Thats why i have parked in that bay same as rest of the people, and thats what has been happening for a while as there is builders and machines, holes and barriers everywhere and as i said there is no signs indicating this car park is finished and operating and that people have to follow any instructions.
Another thing is there was another 4 cars parked in disable bay right next to my car (one even partly parked on the pavement) - none of them had a disable badge displayed (please see attached pictures) and none of them was issued with a penalty ticket (pictures attached). Also there was 8 cars dumped at the middle of the car park outside any bays... None of those cars got a penalty ticket either(see attached pictures), and in this case there shouldn’t be any penalties given for me either… Whats making my car different from other 12…?
Based on this circumstances Im not willing to pay any penalties and please confirm that in the letter or email otherwise i will be forced to take this further.

That was rejected as expected, I’m not sure if I should just pay £60 or try to appeal thru popla... normally I would just pay as I realise it’s my mistake by parking in disabled bay but this car park is such a mess and there was so many cars parked all over and none of them had a pcn. That makes me feel like it’s also unfair but not so sure about it.

It won't. CEL will pretend it will, and will issue a meritless court claim for about £300 in 2019, that you can then defend with no risk as long as you DO NOT ignore it. Tell CEL if you move house as you can't afford to miss any letters arriving at any old address.

The UKPC one, if you parked in a badly-marked disabled bay, take some photos to prove the bay was not well marked or that there was no sign near it to tell you it was a disabled bay. You can then use them at POPLA, if the POPLA code is less than a month old.

And next time come here first. In both appeals you told them who was driving - gaaaaahhhh!! NEVER do that with private firms, why oh why does everyone do this?

If you have lost at PoPLA, then you go into ignore mode unless you get real court papers. Come back here if that happens.

If the other PCN is still live, you need to appeal using the template in blue from the NEWBIES.

Have you complained to the landowner in each case?

It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.

Ukpc one bay is like brand new they just marked it few days before that happened in my eyes this car park isn’t even finished so basically cars everywhere as there isn’t even many bays marked...

And they had a picture of the signs which I never noticed...

I newer knew forum like this existed I wish I came here before I replied to them... 😫

I think you man 'lose'. I already said please just read other CEL defence threads as I cannot keep repeating the stuff that's already there and in the NEWBIES thread that answers those questions.

So complain to the the landowner. You must have an idea or can Google it or ask the facilities on site to cancel it.

I did say it depends on the markings and signs - and that you SHOULD TRY POPLA.

No-one is going to tell you to pay the likes of UKPC £60 but it is not about ''no other cars got a PCN''. That argument goes nowhere, it is about the signs & lines and I already told you that.
