The problem is that the online form also requires me to fill in my address details into separate boxes. There are also pre-canned dispute reasons of which none really appl y to my case and it asks me to state if I was the driver or the keeper. If I say "the driver" they will probably try to find out the name of the keeper?0 -
Stop, read the above...they will contact Europcar anyway.

You are the day-to-day keeper. Unless you tell them, they have absolutely no idea who the driver was. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thank you, I read that. Now the thing is Europcar will still charge me £ 38 to even notify them of my details. I am happy though to send this over to them. The question remains though whether or not I should fill in the online form now or wait until they contact me via post?
Besides, the text from the newbie post doesn't relate to parking in restricted areas and the information on their website includes more than enough pictures. So I am not sure if it makes sense to repeat a request for more pictures.0 -
I would simply wait for your own NTH, and prioritise telling Europcar the score (no phone calls).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ok just done that - I just hope it doesn't overlap because their response time is 7 days...they will probably still charge me a fee for passing my details on, Any suggestions for that?
I also wonder if the new GDPR rules would prevent them fro accessing data through the DVLA and Europcar....0 -

As per the thread I gave a link for: you can do a charge back. Also, the OP on that thread states that Europcar themselves said they would refund the money if the charge was successfully challenged & cancelled. You could ask them to confirm this.
Newbies' thread hire car section explains how to back up your refusal to pay the admin fee. Quite simply, a parking charge is unlikely to be covered by their terms and conditions as it is not a fine or a penalty, it is an invoice.
Clearly there are different approaches to tackling the admin charge issue - I'd try them all in whichever order seems most sensible! And not take 'no' for an answer.0 -
£38 is also clearly not purely administration costs, and would be challengable if needed. If they refuse to cancel the charge, you dispute it with them and raise a complaint, and if they dont resolve it within 14 days perform a chargeback - having confirmed and reconfirmed the T and C do not cover them.
You state you are kepee,r becuse you are. You are also the hirer.0 -

Apologies, yes I noticed that. Maybe I should have rephrased that : Preferably I would not like to be charged in the first place. But I guess that's not an option. Although I thought that maybe it I fill in their online form and I contact Europcar with proof of that, they might refuse to give them the details? I guess that's wishful thinking? lol0 -
So I just went back to the car park in question in broad daylight and without cars parking there it is quite obvious that this is not a designated parking space. But the fact that people are getting caught out again and again for the same mistake (presumably when other cars have already parked there and it's dark) makes me think that this really requires better marking.
I spoke to the Aldi manager first and he was really nice and said that he had so many people approaching him but that his hands were tied because it's not their land but belongs to the landlord who cashes in big time. He said that the landlord even refuses to issue parking permits to staff or otherwise engage in anyway shape or form with the retailers. Funnily enough, the signs say that you are not allowed to park for longer than 3 hours. But all staff (including the manager) park there daily for their entire shift and never get a ticket. So they must entirely focus on disabled parking bays and this particular area by Iceland.
He also said that this is really damaging to the business and that Iceland would have good motives to get this area marked as restricted because it's their turning bay for delivery lorries. But instead, the landlord chooses to cash in on parking fines.
So I spoke to Iceland and they were lamenting over the same thing and that no amount of talking to the landlord has worked. So I asked them what they do if cars are parked up there and they are receiving a delivery and they told me that they just have to wait for the cars to drive off. So it would definitely be in their interest to have this marked as a restricted bay (by the way, there are already yellow lines for delivery vans but they only chose to mark the parking space right on the fringes of the area for the delivery vans, but not the turning space)
Funnily enough, the Aldi manager totally acknowledged that he feels this is a setup and he said that he would not get into any conversation with the PPC.
Whereas Iceland said that it would be better to pay up because one of her colleagues got caught and lost in court (they probably didn't have the backup of MSE..lol)
