    Not sure why you are panicking over a normal set aside case, where I showed you in a very early link, exactly what the Judge will need to be satisfied to set a case aside. Please look back at the links I gave you way back at the start; that's what the Judge needs to be satisfied about.

    What do you need advice on, it's not clear?

    I think I panicked when I realised they had sent a letter (supposedly) to our new address. But I think it's clear that either way they shouldn't have then started sending further court papers back to the old address after experian confirmed my OH new address.

    We have received two separate court dates which is annoying as they are both basically the same!!

    We shall go back and read the threads you posted!

    Do you know if you can submit any documents for the court prior to the set aside? Like an amended witness statement to take into account the new information we have?

    So you've written to the named Judge(s) and asked if these can be merged or heard back to back, give that the facts are the same and it's duplicating and wasting court time? Surely you don't need us to suggest that?

    Well we got the second letter today with the date, I had already asked Northampton to merge them, so I shall have to do that again.

    How about prior to the set aside? Do you think now knowing what I do about experian it makes it a stronger case to get them set aside? Does the judge need to know about this?

    Yes, your local court will not be aware that you asked Northampton to merge the cases, and will not spot these are 2 similar set aside applications among all the others on their lists, unless you write in now.

    They won't realise unless you tell them, that they turn on the same facts.

  • Success!! Both CJJs set aside!! My oh was in less than 10 mins, she questioned why he hadn't changed his address on driving licence sooner, but was satisfied it was a genuine mistake. She said she would merge the two, but couldn't award costs for the two set asides till they refiled the claims with the court. She was more than satisfied with the points regarding the defence, and said he had good grounds to win the case!!

    So pleased!!! Thanks everyone :)

    WHat was the Order in the end? You should know something of what the enxt steps are, and the deadlines.

    I know! At least it didn't count against him!

    She said she would put the details in a letter and send to us in the post.

    I am assuming the ccj's will come off of credit report quite soon?

    Hopefully when credit report gets updated they will be off! I have a remortgage to do haha!

    I will get my OH to phone up! Now to wait and see if they will resubmit any claims!!
