    For each time he attended court for the case(s), including any future appearance. Costs are not rubber-stamped by the court and you may just need to justify the claim to the Judge when costs are being determined.

    You're asking for crystal ball stuff here. I'd never try to second guess any predator, be they a hyena, a crocodile or a parking company. Suffice to say at this stage, UKCPM are currently the most litigious PPC in the country.

    Credit reports aren't updated in real time, from my readings across this forum, they seem to update only on a monthly basis. The precise mechanisms used to update the credit rating operators is unknown to me. Others might advise on this.

    Experian took a month to remove a false and downright harassing 'adverse credit - payment in default' thingy that good old Southern Water plonked on my report last year.

    SW paid me £100 & apologised, when I sent them a stinking complaint letter, of course!

    So my oh has just received an email stating...
    Dear Mr XXXXXXX

    We act for the claimant in the above matter.

    Please find attached, by way of service, the Claimant's Witness Statement. !!

    The assumption is that our Client is not attending the hearing and therefore we kindly request this notice be treated as a notice pursuant to CPR 27.9. However on some occasions our Client may wish to attend and will do so.

    We confirm the statement has been filed at the Court

    So as they are continuing the claim, my oh has till Friday to submit anything he intends to rely on at the hearing.
    The judges order stated that the defendants witness statement submitted for the set aside shall act as his defence. Does this mean my OH doesn't necessarily need to send it again or amend it.

    Do you think it is pertinent to add to the original submitted? And also resubmit with the claimant and court?

    To be honest my OH wants to add to it anyway to counter what they say in their witness statement.

    I would really like someone to read it, is there anyway of uploading it?

    I shall try tomorrow to add to my oh's witness statement and post it here.

    I gave them a call and he can amend his witness statement. The deadline to submit is Friday.

    I have read and read the newbie sticky. But I am really struggling on format. I don't know whether to keep the original format that I used for the set aside witness statement? Can someone advise?

    This new WS will be in support of your defence position about the charge itself. See the example WS in post #2 of the NEWBIES thread and the tips about evidence.

    I still feel I need to have all the reasons why the default judgement shouldn't stand though, only reason I say this is because, uk-cpm witness statement I received yesterday includes a lot of why the default judgement should stand. They argue quite heavily. But surely it is too late for that? Should their focus be why the parking charge should stand in the first place?

    LOL, yes it is too late if it's already set aside!

    Yes, this is the main hearing (they should forget the CCJ, that's in the past).

    Yes please show us a link to their full WS (with your name/address and car VRN, etc, covered). Best to scan everything and host in Dropbox, then reply here with a share link from Dropbox to the pics.
