UKPC Parking ticket (Now received NTK)

    In answer to your questions


    The cinema management had been contacted and who gave a leaflet from UKPC and said we only rent the land we are not the land or carpark owner. They said that they have had a lot of issues.


    The Pizza hut in the same carpark had a same response however they said that they “believed” that there had been issues already with Parking fines, and the council had been involved and there was previous issues – but nothing that has been found that could help my case.

    In Terms of the MP it is in a different county so which MP to go to is the question, also having the outcome of this at hand would make for a more complete communication.

    The have Served the NTK YES, I think that it does meet the POFA exept i dont see how it met the 28 days point. (however is someone more experianced can confirm that then great)


    found the post now in newbies, just didn’t get down far enough.
    So to get from here to a Popla appeal does the Keeper need to reply requesting the number? Or should the keeper wait for a ‘popla verification code to be given if no reply?


    In terms of the Popla appeal, can the keeper appeal based on more than 1 grounds?


    The keeper would like to appeal on:


    1) “authority from land owner”
    In the initial response the keeper requested this information non has been provided


    2) Poor Signs when entering carpark.


    Photos have been taken of this from within 24 hours, at the same time/conditions on the following day.
    more photos will be taken now (maybe just to show this issue now it has been raised as a valid point)


    If the keeper can appeal on 2 grounds the plan is to use the examples linked in the Newbie thread to create an appeal on these 2 points.

    Go to both MP's and don't wait for the outcome of this issue.

    Have you done the first appeal, the one in the NEWBIE sticky in BLUE text? If so and it was rejected, you should have received a POPLA code (assuming it is not a IPC company); if you didn't receive one complain to the BPA, search for Steve Clark's e-mail address.

    You appeal on all grounds possible

    Read POFA schedule 4 para 9 yourself; have they correctly stated the 28 day period? Its the day after that on which the notice is given that the period of 28 days starts from.
  • I see and I understand now about the Schedule 4 – in fact they have done it correctly and stated 28 days. I miss read the schedule to have said “it must – arrive within 28 days’.


    As previously said, they have replied within the time frame.

    So back onto the current course.

    UKPC Gave the the NTD


    The keeper (as they had been going on holiday going on holiday for the whole of December) submitted an appeal based on the Blue text in the newbie sticky.
    Which is what I image the response to was in the letter Dated the 4th Jan.
    (posted earlier today)

    Summery is they say

    ‘Please confirm the drivers name and address to our appeals department within 14 days of the date of this letter.
    Failure to provide this info will give no alternative but to make our final decision based on previous information received. At this stage a POPLA verification code will be provided.’

    So at this stage the keeper is to wait 14 days for the POPLA verification code?

    If this is the case the time can use this time to build up the 2 grounds for appeal.

    You get bonus points back but the driver is already 50 points down for that atrocious parking...it's that sort of parking (even in an empty car park) that causes PPCs to exist.

  • I agree in the first instance it can be seen as bad parking or inconsiderate.


    However I agree with the driver, in this instance for the following reasons:


    -Parking bays are to small for Morden vehicles, especially the sharp upturn in Small to medium sized SUV’s


    - Parking bays are not wide enough for elderly or people with child seats to access without risk to other cars


    -A lot of people see cars as a commodity, however some people care a lot about them and their £25,000 investments, so do not feel that its ok for the cars to be damaged on a regular basis by accident, (wind, slipping door out of hand), children who literally do not give a F*ck what they damage, or people who have no respect for the property of others


    - In this driver’s instance as in this, the car is parked at almost the furthest point away from the location, same in shopping centres, supermarkets everywhere there is not an option to park parallel to a curb or similar.


    -If this was a pay to park car park drivers who care about their car would happily pay for 2 spaces, its much cheaper than having to pay £150-250 for dent removal and paint if one of these inconsiderate runts damage the car… and who owns up to a parking dent.


    -Even tho they park at the furthest point away where the carpark is empty, people with trailers or caravans, or light goods vehicles have the same issue. They have to walk the furthest, get soaked in bad weather, and now get fined for doing so.


    So please for the love of humanity tell me who is in the wrong. because for me it sure as hell is NOT the driver of the car parked across 2 bays at the darkest wettest dingiest part of the carpark.


    If anything its positive decimation that people with kids now have their own bays. To be honest with the issues in child obesity they should be the ones forced to park at the far end.

    I have a medium sized SUV and never have a problem with bay parking (parking cameras help!). But parking across the middle of TWO bays is awful. Not needed.

    I agree and would go further.

    IMHO there should be NO 'parent & child' bays at all.

    On this forum, we regulars rant about them all the time, and stupid or clueless people think they have a God given right to them.

    Then they stick their car in a disabled bay when there are none of their 'special parent - look at me, I actually believe these are needed' gimmick bays free.

    NONONO. Not the same thing!
