  • ok, i will remove the bit about insurance, although i do feel like if they dont have appropriate insurance its another strike against them
  • its amazing how the quality of "stickie" is great on the ticket placed on the car , but absent from the ticket from the ticket machine
  • Yep! I actually work with films and adhesives, so I feel like I should be asking for the product data safety sheets, and material specifications, then question them on there declaration of animal bi product and latex documentation.

    At the end of the day if they are sticking it on someone else’s property they should know what it is and ensure that it is safe.

    Appeal in the usual way, but also:

    Why not set out your knowledge in a Letter before Claim (Google for an example on the Which? website etc.) for the cost of the new wipers, attaching a copy of the receipt and your own findings as a person whose job position is xxxxxxx xxxxxx.

    Then after Christmas if they've not paid up - which they will not - proceed with a claim for £25 - got to be worth it and you are your own expert witness. Get your own back! We encourage a person like you to do this.

    It would be so easy to pay the £60 fine (i have already spent longer then this is worth fighting it) but it feels unjust that these people can act like this with no real reason bar theft and greed.

    So the keeper have these two letters and will need some advice on what to do next.
    As far as the keeper can see they stated they would reply within 35 days (not sure if this counts as them operating outside BPA guidelines or anything else?

    From reading the schedule 4 it looks like this may apply separately?

    (4)The notice must be given by—

    (a)handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or

    (b)sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period.

    (5)The relevant period for the purposes of sub-paragraph (4) is the period of 28 days following the period of 28 days beginning with the day after that on which the notice to driver was given.

    (6)A notice sent by post is to be presumed, unless the contrary is proved, to have been delivered (and so “given” for the purposes of sub-paragraph (4)) on the second working day after the day on which it is posted; and for this purpose “working day” means any day other than a Saturday, Sunday or a public holiday in England and Wales.


    As far as this reads it was 38 working days after the ticket was left on the car until they even printed the letter (and another 2 days until it was delivered it) more then 28 days between NTD and NTK?



    Also, in totally separate evidence, they have breached the BPA guidelines in notifying the driver of entering the contract Via sign, as the sign was not appropriately placed, not on the correct side of the road, not facing the direction of travel and not Lit at all. (we have pictures of this from the time)

    So that’s what there is have and the keeper don’t know what to do next!

    Have you complained to your MP about this unregulated scam? This is the only way this scam will ever be stopped.

    This is between day 28 and day 56, so within the PoFA timescales for a NTK following a NTD. No mileage there.

    I think that is work blocked for me, so a description other than "this letter" would help.

    Have they served a NtK? Simple YES or NO.
    If so, does it mee tht ereuqirements of POFA? YOU will be entirely aware of this by now, as you have had a month or so to prepare.
