    What is the Issue Date on your Claim Form?

    Did it come from the County Court Business Centre in Northampton, or from somewhere else?

    With a Claim Issue Date of 15th February, you have until Wednesday 6th March to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

    Having done the AoS, you have until 4pm on Wednesday 20th March 2019 to file your Defence.

    That's over a month away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
  • Ok thanks..I am going on holiday on 7 march so I better do it sooner rather than later.
    Are there any good examples of defence letters for Newcastle airport byelaw fines?

    There are good example Defences linked from post #2 of the NEWBIES thread.

    There may not be any mentioning Newcastle Airport, but use the forum search facility for specifics like that.

    But look at the examples first.
  • They must be having an admin clear out - my Newcastle airport claim form was also received today dated 15 Feb - but mine dates back to 2016. I'll be drafting a defence for comment on my thread too.

    Just a batch of robo-claims from BW Legal, as per usual. Very defendable and the evidence is likely to be rubbish, as UKPPO used the Airport grainy CCTV, I believe, not proper cameras, and I know the signs were sh33t!

    Seen loads of these over the years. There's also an element of question over the landowner authority because UKPPO were contracted by another parking firm, Park & Fly Ltd, I seem to recall. Not the Airport.

    Just one contractor conspiring with another to misuse the Airport CCTV to penalise people.

    Apart from the fact that some of your PCNs might emanate from when UKPPO were in the BPA (so that the old BPA CoP applied, not the IPC CoP) you can all do the same defence, so start work on researching it...NEWBIES thread.

    You can tell when UKPPO joined the IPC from the BPA, from the IPC website. So check that first, so you know which CoP to say they were in breach of.

    The only other thing to check is that UKPPO went through a short lived (few months) phase of issuing what they misleadingly called 'penalty charge notices' rather than 'parking charge notices' and if yours was the former, your defence should mention their misleading business practices and impersonation of a Local Authority.

    All do your AOS to buy you time to work on these defences together, might be good for all 3 of you to private message each other to stay in touch & discuss your cases, and if you are local to each other, maybe even attend each other's hearings to assist/learn and generally give yourselves confidence in numbers.

  • Hi all !

    I’m your 4th person to receive a NTK while a car in my name was caught by cameras stopped in front of the Newcastle airpor Hilton barrier for 5 seconds. This took place in July 2017.

    I’d like to express my thanks to the regular posters, you know who you are. Thank you for your time and expertise.

    I’ve been following the forums for the past two years. Now that I’ve received my county court claim from Nottingham business centre, I’d like to make contact with the others involved. So that we can write a defence and tell this company where to go. Claim letter dated 15 February 2019.

    New to posting to the forum, so still finding my way. Have PM’s and email contacts been exchanged? If so how can I exchange mine?

  • Has anyone successfully won a case against a PCN for airport byelaws? If so, what was their defence?
    We have created a group - there are 6 of us. We have all been issued with claim forms from the County court Northampton and we would like to know if there is a successful defence we can use?
