    I think there is an 8th person I replied to the other day.

    I suggest all of you exchange pm's and come up with ONE draft defence please, to save us duplication and to keep you all on the same page, so to speak.

    Choose one of your threads to show it on for comments.

    Look into whether UKPPO were in the BPA or IPC at the date of each of your cases, because whilst the claims are near identical on other facts, your dates of event will differ, and also, some of you might have PENALTY CHARGE NOTICE and others of you might have one headed PARKING CHARGE NOTICE, as UKPPO flipped between the two a few years back, and dabbled in calling it a 'penalty' for a few months.

    If you are all local you may wish to attend each other's hearings in due course but that would be 100% your decision to be in touch with each other - I know MSE warns people to be wary of off forum contact.

    Hi

    Please can someone tell us if we should first defend our cases by stating that the parking charges for breach of byelaws should be decided in the magistrates court rather than in the county court?
    In other words, should we contest court jurisdiction?

    Thanks - because some of us have already said on our Acknowledgement of service that we are defending the whole claim, is there a way of changing this to 'contesting court jurisdiction'?
    Just been online on my claim and i cannot see an easy way to change it.......

    I have today received the same letter from the same company because I used the drop off lane for cars instead of the drop off lane for taxis and cars with more than 7 seats. My car has 8 seats but is not a taxi or minibus so I used the car lane. I was dropping my sons off at the airport and then I paid the £1 to exit the barrier. I am disabled and I had my wheelchair in the car with the luggage and so seats were removed from my car to accommodate this. The airport is charging me because if the make and model car I drive not for anything else. This company now want my house hold income and expenditure and I can’t prove how I am not liable for these charges

    Your case is not quite the same as these ones are about court stage and it sounds as though you are pre-court.

    I have received a letter of claim from BW Legal, on behalf of UKPPO Ltd, stating that I need to pay £160 for a parking fine by 8 December or they will issue a claim against me in the County Court.

    I am the registered keeper of the vehicle but not the driver (when the so-called contravention took place).
    The alleged contravention took place in February 2018. Since then i have received letters from UKPPO, then from a debt recovery agent, and now from BW Legal.

    The alleged contravention is 6.3 - Parking in prohibited area (i believe this is a byelaw of the newcastle airport, however it is publicly accessible road to everyone). The driver dropped someone off at the barrier of the Hilton hotel next to Newcastle airport (it was a matter of seconds), then they reversed away from the hotel barrier and drove away.

    They are stating that if it goes to County court, i will be liable for the following:-
    Principal Debt + Initial Legal Costs = £160.00
    Estimated Interest = £5.52
    Estimated Court Fees = £25.00
    Estimated Solicitors costs = £50.00
    Estimated Total = £240.52

    The initial parking charge was £60 and then became £100 after i failed to pay it.
    They say that the £60 extra (on top of the £100) is due to Total Debt Recovery costs,

    Please can you give me some advice as to what my next steps should be?

    I have the exact same ‘letter of claim’, from BW legal chasing on behalf of the UKPPO at newcastle airport, after receiving a series of debt collection letters from parking in a prohibited area 2 years ago. They say that it will go to court next month. 

    Please can you tell me if you had any success appealing the decision?
    Do I need to do anything now, or wait for a county court letter?
    I am thinking of just paying the £160 for peace of mind, since I have absolutely no defence, I was just picking my boyfriend up at the airport. Any help would be appreciated! Thanks.
