If you have the industry verified meter reading, work out what they owe you, and try a Letter Before Action, followed by Small Claims Court procedure. They may pay sooner to avoid the court fee.

Defendants don't pay the court fees

They all have to be paid by the claimant in the first instance, (beginning as soon as the claimant commences "small claims court procedure"

Only if the claimant wins a judgement against the defendant would the defendant have to refund the claimant for fees paid.

If the claimant loses then they cannot get any refund of court costs
True, but what I meant was that the LBA might encourage OTM to pay up - before any court fees are raised.

There is a report on the Facebook OTM discussion of OTM having to pay a £25 court fee.

I switched to So Energy which completed on the 20th December. I gave So a meter reading but they told me it must be wrong because OFTM inform them it was higher. I sent them an image of the meter which now So have had to file a case against OFTM to prove my reading (via photograph) Today (7th) OFTM have taken £117 from my bank (I was in credit with them) which is unlawful. They not only owe me (which looks to drag on in a conflict with So) the credit, but now £117 on top of that. I cannot afford this. What can I do ?

Went onto OFTM chat and someone else took over. They instructed me to wait 30 seconds while they read through the previous transcript and I never heard from them again. The chat shut down after 30 mins.

Contact your bank and get the DD reversed under the DD Guarantee. Also tell your bank not to pay OFTM if they try to reinstate it (as they probably will do)

I have canceled the DD and contacted the bank but didn't ask them to reinstate it. Will add that though but I don't think they will be able to do anything about it.

OFTM have even tried to get my Trust Pilot review taken down as defamatory content. It isn't.

Best way to keep chat going is to post the time every 5 minutes. When they ask why you are doing it tell them its for evidence to give to OFGEM about poor service. They will comeback very quickly then. Plus eachtime you post something in the chat they hear it.

Oh, if it's on Facebook it must be true :rotfl:
  • Has anyone ever had a transfer from OTM recently that has been plain-sailing? I was going to transfer from this lot as I don't think they're the cheapest anymore, but all I read about is OTM reinstating Direct Debits and folk waiting ages to get their final bills.

I have a transcript of the chat via email so all evidence is there.

They must not like you very much as every time i go on chat they reply pretty quickly. This morning when requesting a final bill 10 messages were exchanged in less than 6 minutes from me starting the chat.

I've seen the Facebook page and a lot of people are being quite rude to the staff on the chat and sometimes asking silly questions just to be funny or get their backs up which doesn't help.

I have always been polite and reasonable considering the circumstances.

I left OFTM on the 20th and a week later they took a DD that was double my usual amount even though I was in credit.

I phoned OFTM and they recommended phoning my bank and using DD indemnity to pull the money back the same day. I did and it went through fine,

I've just got to wait for the credit amount, but at least I'm not further into credit.
