Fruitcake, apparently the blue badge scheme applies anywhere. Good job Apollo 11 didn't land in a disabled parking bay.
This has really got to me, the hours and hours spent researching and fighting this just to be kicked in the face. Remember when George Osbourne's chaffeur was photographed in a disabled spot, do you think he was fined? One rule for the elite another for the peasants. More cash you have, the more justice you can buy.

The judge we had, apparently started his legal career as a parking adjudicator for 5 years. It's all just a roll of the dice and the courts contradict themselves. Rights in this country are slowly dwindling away and no more so than the rights of disabled people. I think I have to let this go now before it consumes me. The little person loses, what a surprise.
A parking adjudicator for on-street law has a skewed view. Bad luck you got him.

Do you want some free help to word it? I am keen to help you if you are up for this. I feel you were wronged, can't promise an appeal will win but you sound like you don't want to let it lie.
Do you qualify for help with fees, on income grounds? Such that the appeal fee would be free? Help with fees is not just for people on benefits.
Did you also have a counter claim that failed?
If you have decided to let it go then fair enough but wait, sleep on it and think about it over the weekend. If you qualify for a free appeal then this one might be worth the test, especially if you told the parking firm in an early appeal about the disability and the right to park there...so they KNEW.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Every time.I did post about the case, but I was fairly confident I had it in the bag due to the equality act stating that a service provider cannot dictate the terms of a reasonable adjustment that has been provided for a person of protected characteristics. Coupon Mad did comment on my original thread, but with hindsight I should have posted my defence on here.

blue badge rules are just made up by UNREGULATED companies , the UK gov states that blue badge is NON applicable or law on private land1

I think that I would write to your Sir Greg Knight and copy in your own MP. There is so much disparity between council car parks and PPC's. If your minor transgression had taken place in a council car park the PCN would have been cancelled on production of your blue badge.

I want this case to go to the higher courts where win or lose a precedent will be set so once and for all disabled people will know where they stand in regards to the equality act, disabled parking and private carparks.
Yeah we should definitely qualify for the appeal fee on grounds of income as we qualified for the counter claim fee for a £1000. I would gladly have given that money to a disabled charity if we'd won, it was never about the money, it was about justice and fairness. I'm the sort of person that would die before I gave in to an injustice, but unfortunately this is having a detrimental impact on my wife and seeing her suffer is what makes me buckle. Is there a way to take this on so my wife wouldn't physically have to attend court? She's just not fit enough mentally and physically to go through the whole legal process. She's bed bound most of the time in constant pain from trigeminal neuralgia.
The carpark company were told from the get go about my wife's badge, sent a copy, told several times about the equality act and how it pertains to private carpark parking law. I lost to Gladstone's, oh the shame. I think the best lawyer in the land would have failed against our judge. I knew as soon as I saw him that it was going to be an uphill struggle.
I'd love a hand with the appeal and can't thank you enough for the offer of support, it's just that my wife's health complicates matters if she can't be taken out of the equation. I really am chomping on the bit. I wish I'd have said I was the driver now ( I wasn't) but then I maybe could have taken these clowns on without my wife being involved. Our daughter was driving the car and didn't check that the badge was on display because she was more concerned about her Mum getting out of the cold ( it was February) as it makes her Mum's condition exponentially worse. Trigeminal neuralgia is no joke and is known as the suicide disease as many people take their own lives rather than deal with the pain but of course we all think about a badge when we see our loved ones suffering. I REALLY want to take this as far as it will go. Let's get some clarity on the matter.0 -
So if the Blue Badge Scheme applies on private land why does my local NHS hospital charge for BB holders using their car park ??0

BLUE BADGE SCHEME does NOT apply On private land , however your local hospital may be using a private company to look after it1
