And I think they would quake in their boots about a disability discrimination claim and the possibly publicity. Your Letter before Claim could work well, and it may be the final straw that makes them cancel the contract if they see this and your wrath aimed at them. My wife and I are both on benefits and received help to issue the counter claim. I don't know if legal aid would cover an escalation to the higher courts. I'm surprised a similar case hasn't already been to crown court, but am I right in thinking a precedent would have been set if that had been the case?
I'm currently seeking advice from a solicitor that specialises in discrimination, so I'll let you all know how that goes. I'd love to see a professional take on this case, and I'm the sort of person that will fight to the death, but this is really worrying my wife and telling on her health. She was in agony today and definitely didn't need to be dragged to a kangaroo court. Just our luck we probably got the only Judge in the UK that would side with HX Parking - sure they are partying over this decision.
Thanks for the advice, I'll look into all the suggestions after I come out of shock. According to that judge, badges have reasonable adjustments made for them and not people. How can he just rubbish what is already enshrined in law?
I'll definitely keep plugging away and ask for advice from here this time as my confidence has been shot to bits. I don't regret standing up to the bullies though. The battle is lost, the war...? I'll keep you all in touch.0 -

You know, on this forum there are many very clever people, some are solicitors.
I think your first job is to scare the living s*** out of the landowner, and I am sure someone will be along to help you with this.
The EA is not a legal product to play games with especially for the landowner.

Nonsense. I think that, if this is the sort of handle the judge has on parking law, you need to make a formal complaint against him/her to the Judicial Appointments and Conduct Ombudsman. HH seems to be not the full shilling imo.

I'll try to sort out the merged threads. I was being sarcastic about the judge and badges having reasonable adjustments and not people. But if it's true that actions speak louder than words then?
Would it be wise to take on the land owner on grounds that have failed (rightly or wrongly) in court? I'm genuinely asking.
I'm still in shock how dismissive the judge was. To read out passages from the equality act and apply them to our case, and he just ignored everything I said and decided it's all about the badge, sorry.0
