    I sometimes wonder why I bother with the POPLA info in the NEWBIES thread, given the amount of times people don't read it first.

    Why certainly not? Isn't it up to them to prove that where I parked was a warning signage visible?


    They have not provided that. I cannot take photos and videos of the places I park at the time I park to prove that there is not signage.


    It is them (also based on my experience from other notices) who need to provide photos of their signage IN RELATION to the place I parked. They have failed to provide me such photos.



    This is the strongest argument, I am not sure why you think it's not enough?

    Sorry, I've re-read you question and can see my mistake.
  • POPLA appeals need to be carefully written in order to ensure victory.

    You need to attack on all fronts, not just say "well they didn't do X".

    The Newbies posts tell you all you need to know.

    You are fighting a system loaded against you. The idea is not to give POPLA any wriggle room to find against you because if they can they will.

    You don't need to read s thesis. It really isn't that difficult. You have plenty of time to read and digest the information before writing your appeal. You would have had longer if you had done some homework beforehand but we are where we are.

    I will write all the bunch of text in the faq but I expect them to ask Flashpark for further evidence as the photo they sent me shows no signage.

    Flashpark will submit a witness statement saying you were incorrectly parked and POPLA will accept that as evidence.

    That would leave your sole appeal point shot down.

    The process is:

    1) you submit your appeal.
    2) PoPLA ask the operator to comment on your appeal.
    3) you get an opportunity to challenge the operator's comments.
    4) the PoPLA assessor makes a decision based in the information available.

    PoPLA will not be asking the operator for further evidence.

    You get one opportunity to present your case and evidence - in 1) above.
