    The Govt tried (weakly) to ban penalties at MSAs about 8(?) years ago and sent out a consultation - a general one dealing with lots of MSA issues & policies - where the strong starting position from their end, was that people should be allowed to pay the next day (like a congestion charge) and not be penalised because they knew about reams of complaints from tired motorists & wanted to protect them.

    ...unfortunately we spotted the consultation too late (it was before we had high profile people like the Parking Prankster and stakeholders like the BMPA to be alerted to such things).

    Guess what the outcome of the consultation was, once the BPA got their comments in? Yep...all trace of common sense removed in favour of fines.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Not the infamous BPA who tricked government into POFA2012, who also made the infamous Wright Hassall solicitors a POPLA and after sacking them dreamed up the current POPLA with tea boy types as assessors ??? :rotfl:

    There is a case relating to a similar scenario between Parking Eye and Nicholas Bowen. Unfortunately for Parking Eye Nicholas Bowen is a QC. It's a high profile case which attracted media attention and comments from the AA

    Because CP Plus (I assume it's them?) will probably fold as soon as they see the template appeal from the NEWBIES thread and as long as you do not start implying who was driving by writing your own appeal, they will cancel.

    Even though you live in Scotland, I would submit it and just add:

    'NB: you may wish to note that the appellant registered keeper stays in Scotland and the driver will not be identified'.

    If CP Plus do not cancel then complain to MOTO but without saying who was driving. EVER.

    And CP Plus should still give you a POPLA code if the MOTO is in England (Cumbria I think?). And you then win because they can't hold keepers liable and you will have never implied who the driver was - that's how to beat CP Plus.
