MOTO Southwaite charge for sleeping in car

HELP! What do I do? MOTO Southwaite want £100.00 for 1 hour 25 minutes?
On Sunday 14th Oct after being on my first holiday in 5 years in Croatia I drove to Dubrovnik airport from Korcula island, flew back to the UK, and then started to drive back from Manchester airport to Glasgow on the M6, but was so tired that I stopped on route for a break for what I thought was a couple of hours sleep in my car. I then got this Charge Notice:
My car was recorded “at MOTO Southwaite North on 14/10/2018 from 02:58 to 06:23. The duration of the stay exceeded the free parking period, and payment was not received for parkin in excess of the free period.
The payment of £100.00 is required (i.e. for 1 hour and 25 minutes in excess of the free 2 hour period) within 28 days from the date of this notice (22/10/2018). We wll accept the reduced sume of £60.00 if payment is received within 14 day, i.e. before 05/11/2018. If payment is not received within 28 days, an nitial debt collection charge of £40.00 will be incurred.
What should I do?

    a) Stop using silly fonts in a forum post.

    b) Read the NEWBIES thread - your situation is not new, and is essentially irrelevant.

    c) Edit your post ...The Driver did this, The Driver did that. (Parking companies trawl this forum ... it is entirely probable that the PCN you've received does not comply with POFA therefore don't make it easy for them to identify the driver).

    Follow the advice above never name the driver, and don't bother with all that irrelevant waffle the PPC's won't even read it, you are being scammed by a money hungry firm of muppets.


    The reduced fee is a bribe to get you to pay up and shut up with the least hassle.


    When you park anywhere in future search out the signage and T&C's it will save you all the long haul you are entering, the days of fluffy cuddly car parks have been replaced by greed!

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed in the house as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week, hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an
    M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.

    Who is this parking company that says ..

    "If payment is not received within 28 days, an initial debt collection charge of £40.00 will be incurred."

    Was this just on the ticket or on the car park signs ?

    Write to MOTO with a good explanation why they should cancel this ticket pointing out you obeyed motorway signs that say ...
    TAKE A BREAK and TIREDNESS KILLS which as we all know do not give a time limit on

    Do you live in Scotland? Is your vehicle registered in Scotland? Is it a hire vehicle?

    I can't believe how many motorists are unaware of the 2 hour limit on Motorway Service Areas.

    Until the Government get sensible and cater for tired motorists as they do on the continent, drivers need to be made aware of this blanket limit on UK Service Areas.

    Tell your friends, children and anyone who may be vulnerable.

    Complain to MOTO without saying who was driving.

    And beat the scammer by appealing as KEEPER. All covered in the NEWBIES thread.

    I don't even see the point of parking companies in these service areas, who would want to spend hours being ripped off and then maybe have to pay £100

    Probably take years before the government will twig. Nothing will happen until an MP like Betty Boothroyd comes along and is hit by scammers because they obeyed the motorway signs to "take a break" and "tiredness kills"

    Co-incidentally I spotted this article yesterday highlighted the prevalence of driving whilst tired.

    I'm wondering how difficult it would be for government to address this issue when it comes to motorway service areas. Aren't most if not all motorway service areas operated under a lease from Highway England/Scotland or Wales?
