If you agree to mediation ask THEM for recompense for the time you have wasted on this claim. The court approved rate for litigants in person is £19.00 an hour.
Have you complained to your MP?You never know how far you can go until you go too far.0 -

Have you complained to your MP?
YES. I have complained and they have said that they will shame them in parliament when parliament sits again. He is still waiting for replies from NCP who have failed to respond to my MP.
I am waiting for a phone call re mediation. I did not know you can ask for recompense?0 -
I don't think you should agree to mediation then say at the last minute that you don't want to. That may not go down well with a judge.
By all means ask for mediation and your claim for costs from them as your opening offer. Alternatively make a drop hands offer.
Either way you can show a judge you were trying to be reasonable and avoid bothering court.
I do hope you have mentioned the lack of planning permission and advertising consent. I for one would really like to see this tested in court.
Have a look here at post 19 for a couple of discontinued cases where the defendant pointed this out.

Thank you Fruitcake..
Yes I have mentioned lack of planning permission and advertising consent. I am also trying to put a complaint together to send to the SRA. Any advise would be greatly accepted... I have looked at post 19 and followed the link and that is one great put together defence all for the right reasons. I also have written evidence from the Council.0 -
Just a quick update:
So, we are in mediation stage. NCP would like mediation. I will go through with it but not accept this because: I am waiting for the court to call to confirm now.
It has now come to light NCP submitted retrospective advertising consent but this was refused by the Council. It is now going to planning committee in February.0 -

WHOOPS NCP .. no mediation .... NCP knows they have failed
Let a judge whoop them and claim your costs.

Don't worry, just want to see what they say on the phone. Will be going to court. Its not the money, its their illegal behaviour. Yes BW Legal indeed.0

BWLegal known as the Sean Barton experience.
Barton is the big honcha of this appalling set up to scam people.
He sends "rent a mouth" bods to court who are clueless
Would Barton ever appear in court himself, no, he is a chicken0 -
Sean Barton and Ms Withers appear to be the Directors. They are going to be reported to the SRA when I get the time.0
