    The real DQ will be sent to you by the court, with an order telling you the date by which you must file/serve it.


    I don't think you can be "entrapped" into mediation. It's a voluntary process and you can't be forced to do anything. I've done it once in a claim I issued (not a parking case), it was laughable, but we did settle (on the terms I'd offered already). It's pointless in a win/lose case where there is no middle ground. And it's certainly pointless against a PPC.



    I will NOT be going to Mediation. Anyway, thanks for all your help.

    OK - quick update. As some of you know I received a DQ from BWL stating that their client NCP intends to continue with the claim. These cowboys (BWL) then say "we have notified the court".

    This was nearly 3 weeks ago. I phoned the Court and they just informed me they have NOT received any instructions !
    So, why would they lie?

    Does this not go against the Code of Practice under which all solicitors must abide by? Should I be setting up some form of complaint against BWL now to the SRA?

    Probably because BWL are so busy busy taking fake claims to court.

    It is clear that the SRA work on the "rubber band" theory that stretches their own principals so far in both ways that they end up in nobody knowing what is going on ..... it's very sad

    UPDATE:

    I have now received Notice of Proposed Allocation to the Small Claims Track. I am NOT going to mediate but would rather see these culprits in Court for their wrongdoing. Should I agree to mediation knowing that what is said is not binding just to waste BW Legals time and then carry on like before and just go to County Court? BW Legal has requested Mediation.

    Mediation is just some bod with no knowledge about this scam who will probably support BWL as his/her job is not to let this go to court
    If BWL won through this unregulated method, that's it ?

    BWL are now unsure of their position hence their request. You say NO to mediation, you want them to face a judge with their usual rubbish. Get a judge to whoop them and claim costs

    Of course the other thought pattern is that they have run out of "rent a mouth legals" who they send to court

    OK, My thinking behind this, is to agree to Mediation to see from a learning point of view exactly what goes on, but at the last min tell them that I will go to court.


    Its their time, not mine. The time in costs to them will be more then £250 or so. I guess I am just prolonging their stupidity even more so it cost them more for their staff costs.

    DQ now been sent. They want mediation, I want justice. I will go along with their game only to decide that I will not be agreeing to any proposal they put forward. Will keep you updated..
