Good evening.
I have now received Directions Questionnaire from BW Legal.
Please could you advise what to do with it etc?0 -
treat it like a gladrags one, read post #2 of the NEWBIES FAQ sticky thread and follow the advice in there
you are awaiting one from Northampton CCBC, BW are trying to ambush you0 -
OK - The one I have from BWL it appears they are requesting Mediation? So, am I meant to be waiting for another one? It states on the form, "You should note by which this questionnaire must be returned, however there is no date.
In A1 it states " Do you agree to this case being referred to the small claims court Mediation Service. They have put a cross in the YES box.
Im a little confused..0 -
Please read about 'Mediation' in the NEWBIES FAQ sticky, post #2. It's all there, explained by legally qualified regular - bargepole. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

I do hope you understand that you are subject to the biggest scam in the UK ..... from PPC's through to dodgy legals
MEDIATION ? ...
Would you trust a guy living the other side of town to listen to your case and rule in your favour ..... and you don't even know him ?
THAT'S MEDIATION and if BWL thought they had a winnable case they would go to court ....... they know how mediation works
By the way, auto ticked boxes is just how the banks forked out £millions for mis selling ... just one part of the PPI/ banks scam0 -
That is therir copy
As you will have read, the Claimant sends a copy to you and the court, and you send YOUR DQ to the court, and a copy to the claimant.
Check MCOL see if DQ was sent out
If not, or even if it was, you can just download form N180 off gov.uk. Easy enough.0 -

Is this not malicious entrapment by a "qualified" solicitor of an unqualified litigant in person?0 -
The real DQ will be sent to you by the court, with an order telling you the date by which you must file/serve it.
I don't think you can be "entrapped" into mediation. It's a voluntary process and you can't be forced to do anything. I've done it once in a claim I issued (not a parking case), it was laughable, but we did settle (on the terms I'd offered already). It's pointless in a win/lose case where there is no middle ground. And it's certainly pointless against a PPC.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. I accept no liability for the accuracy of any such posts and users are advised that, if they wish to obtain formal legal advice specific to their case, they must seek instruct and pay a solicitor.0 -
But you're someone who knows the court process. Most people who receive such things won't, so they may be hoodwinked into a poor settlement by agreeing to mediation. (Anecdotally, the mediators tend to side with the claimant and push the parties to agree a settlement closer to the claimant's claim, even if the defendant has a high probability of winning and not needing to pay anything at all).0
