I appreciate it, despite having left the court feeling embittered that I had given up so much time for what seemed like a cause that the DJ believed was daft to take on in the first place.
Given the admission you had been to that site before, then it would be a given that the signs were there to be seen and read. There is a lot of "sign blindness" going on. Perhaps it would have been simpler to have checked prior to parking.

That sort of comment is totally unhelpful, spiteful and petty. Anyone can be sarcastic and patronising from a safe distance and in retrospect. Im an extremely busy full time teacher who has done their best to take on VCS despite zero legal training and no prior understanding of any of the relevant legal issues, precisely because i was encouraged to do so on this forum. Do you really need to mock someone in my position to feel better about yourself?0

These cases are helpful for others. And as an educationalist, you'll be happy to share so others can learn.
These all come down to details such as your comment in court that you had been there before plus this oneI do however recall that I was a present in the car at this time.
You'd have driven past not only signs, but also parking bays.
However for some reason you saw the light but either misled yourself or were mislead quite early on that you had a case.So my question is, surely I don't have a leg to stand on with this particular claim about POFA? I'm not trying to argue myself into losing the case, but I don't want to attempt to rely on this criticism unless someone can explain what I'm missing here - I've read and reread other threads and can't make sense of how this argument can be relied on in my case.

I am so sorry to read you were railroaded in court, mooney89.
Re the 'Rights of Audience' thing, the Judge wouldn't ask you about it, and if you were up for and prepared to argue that, then you should have cleared your throat and raised it at the start, handing over case law in support (but only if you felt confident and it sounds like you didn't).
You needed to be able to talk through how VCS do not comply with para 9, word for word. Did she not let you do this? Or was she just dismissive/not listening?
As for the added £60, you needed to object to that with clear info as per your defence/WS - you knew they couldn't add £60 and needed to mention it when you felt the Judge was against you, to at least protect yourself from the 'fake sixty quid' add-on scam if you lost.
And as for worrying about what Socrates_1 said, look how many posts he has, then click on his username and read those 9 posts and the replies to him since he joined last week - the regulars here believe this is a PPC employee.
It's pretty clear from his posts and nothing to reply to or worry about. You do not need to beat yourself up, you do not need to be criticised by a new poster who appears to have an agenda here.
Be proud that you fought this scam and you cost the scammers more money than you had to pay, and you were simply a victim of 'DJ Bingo' (= you got unlucky with a bad Judge).
Finally, which bad Judge and Court was this? There are one or two bad apples, for example, Swansea is one where honest motorist defences go to die...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Any chance of a bit more detail - a report of the background to your case and what happened on your day in court. But please start a new thread of your own. I'm sure your experience will be extremely helpful to others.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Sorry to hear that you lost Mooney.
I lost against Excel (owned by the same people as VCS). I only had to pay a minimal amount to Excel and I will explain what has happened since and how I have dealt with it.
I sent the payment by cheque within the first week following the hearing with a covering letter and requested a receipt. Obtained proof of posting.
To cut a long story short, they sat on the cheque for over a fortnight before presenting. I managed to obtain a copy of the cheque from the clearing department of my bank and a letter from my bank to say that the cheque has been debited to my account. I have sent all this to the court. Experian search is fine at the moment. I used the checker on this site.
You may be more likely to obtain a receipt from the PPC than I was however take your own steps to evidence payment and send it to the court.

I agree with Ukomaas that it would be useful to have more detail. Another poster who has been caught out on the same car park as myself is fighting a claim regarding a restricted area at the moment.
