Seems they have suddenly changed their mind not much ping ponging going on. And not even responsive to the newest offer I made.

I read that as being in regard to your defence, not your WP offer. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I will write a new WPSATC letter making the offer. I don't think they even bothered reading the reply they sent me which was below my new WPSATC offer. I think new people just look and reply without looking at past communications which is crap But hey they are only interested in fleecing people so why should they care.0

So is sweetgem doing the right thing by re-sending the offer?
As I see it, if it's felt that it hasn't been answered, there's no damage done in repeating (it can't be shown in court), but I just wonder if the letters are a bit out of sync, insofar as the latest response is not to the WP offer, but to an earlier letter. Who knows, the OP’s guess is as good as mine, probably much better, as she has all the letters in front of her. I’ve never seen one of them.
It’s just so difficult to having to guess so much of this stuff when posters are requiring definitive answers.

So got a reply back again same answer. What are they playing at. They want me to say yeh I will pay you then £125 you are asking for.
This is what they said
We refer you to our previous correspondence which stated that ParkingEye can confirm receipt of your correspondence, however, we note that you have filed a defence to the above referenced claim.
Therefore, the points you have raised will be answered within our future pleadings/evidence.
Yours sincerely,

The funny thing is when I initially wrote the first letter they said ok we will accept £125. And when I put a counter offer in both times I got the above reply.
How can I say to them you were quite happy to accept an offer of £125 but I said it was a bit extortionate for parking for 1 hour 16 mins when I wrote to you the first time. And I am willing to pay something reasonable So come back to me with a suitable and less insulting offer and writing me those generic replies about we have noted your correspondence bull0 -
sweetgem, I'm not knowledgeable about this stage of things, so don't be confused by my thoughts here.
It looks to me as if P.E. are no longer willing to engage in mediation because a defence has been filed.
However the letter doesn't specifically refer to 'mediation', nor does it mention the £125. That leaves a bit of a question mark as to whether or not it is about mediation.
I can help with a response but first it's important to be sure what P.E. are referring to.
At the moment it just sounds to me as if P.E. will not be engaging in any further haggling. It may be that I just don't know enough, but mediation-wise, I suspect the best you can hope for is that they might still accept £125.0 -
There's no point continuing with that correspondence but if you have it in writing that they ACCEPTED an offer to pay £125 then you must secret that email away in your court bundle and whip it out at the hearing if you lose the case, and when it comes to the matter of costs which the Judge will then move on to, guess how much they will be able to get, max? £125 altogether!
It won't even cover their hearing fee even if you lose!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I can't speak for the OP as such, but I am aware that they are very apprehensive indeed about a court case. The above is therefore very interesting.
Personally I think court is worth a punt. But from what you say, one would think that P.E. would indeed be likely to accept £125 now ...
What are your thoughts sweet gem?0
