My Father is coming to stay with me but the TA says no vistors permited for more than 3 weeks.

    But apparently the clause is illegal and unenforceable and the hard pressed HA might say exactly that.
  • TThe other commenters are wholly correct - he will not be entitled to any help at all for the first 3 months. Possibly longer, depending on the circumstances. He’s also very likely to not be considered a priority for housing as he has somewhere to live so whilst he may be entitled to housing benefit or local housing allowance but he will only be able to claim those once he has a tenancy in place. So he’ll need money for a deposit and first months rent, likely, as well.

    You can’t just bring him home & expect benefits and a house for him, I’m afraid. Did he not envisage needing to return and make appropriate arrangements when he moved out there? If not, well... these are the consequences.

    Your father is 60 and until around four years ago worked in the UK, latterly for Leeds City Council.

    He was made redundant and received a redundancy payment and also a pension?

    You mentioned that he had accessed other pensions early and "pays tax on them".

    You also mentioned that he had some savings.

    It is possible that even after three months he may be found to have too much income/capital to be eligible for means tested benefits?


    PIP is not means tested - you mentioned that he has a condition which affects his mobility and perhaps limits his ability to perform other daily tasks?

    Has he checked on his UK state pension position?

    I am aware of his possible situation & the fact that he may have to wait for any type of benefits. He has a rare medical condition called Ehlers Danlos Syndrome which effects collagen production. This has developed rather fast over the last few years to the point that he is finding it hard to walk. He could not get the treatment he needed over in Italy so he has to come back here.

    Firstly this is none of my doing & I am getting rather stressed out & upset about it all I dont need someone assuming that I am just bringing him home & expecting benefits. He is not well & he is my Father & I have to do what ever I can to help him. He worked right up until he left for Italy for Leeds City Council, he isnt some kind of benefit cheat or anything. Sometimes we make choices in life & things do not go to plan. He was hoping to settle down in Italy on his savings but due to his health this is not going to happen. I was asking for advice on my situation & not a telling off by someone assuming things they know nothing about.

    I have come to terms that this will more than likely be the case but my priority is taking care of my father & helping him as much as possible. I just would like to be reassured that I am not going to get kicked & & become homeless because I am letting him stay at my new place.

    Has far as I am aware he has less than 3k in savings. He had more but he had to pay for an operation in Italy a few months ago.

    It depends where you live I guess, where I live there are sheltered housing flats that are almost empty so an older person could get accommodation immediately.

    Advice given on Assured and Regulated Tenancy, Further advice should always be sought from a Solicitor....
