Ethical Parking, ZZPS, QDR Solicitors

Hello All,
In 2013, I received multiple parking tickets (NtK's) from parking at an educational establishment. These were for three reasons: overstaying, failure to pay & display, parking in the incorrect bay.
Notice to Keeper letters were received (Ethical Parking). Some of these NtK's were sent & dated late (after the POFA deadline).
Several letters were then sent by Debt Recovery Plus.


Four years then passed by. A couple of months ago, letters were sent by ZZPS Ltd demanding payment. I sent this as a response:

"I am writing in response to your letters regarding the “debts”, referenced above, for your client Ethical Parking Management.

I am writing to inform you that these “debts” are in dispute with your client and I have contacted them directly again today to dispute these.

As these “debts” are in dispute, I will not engage in further correspondence with you, but directly with your client."

ZZPS responded to my letter, acknowledging it but advising the case was being passed to their solicitors.

A couple of weeks ago, letters arrived from QDR Solicitors demanding payment for outstanding debts. I sent the same letter as I sent to ZZPS. In addition, I sent the following to the PPC Ethical:

"I appeal and dispute your 'parking charge', as the keeper of the vehicle. I deny any liability.

You failed to serve the notice to keeper within the required timeframe mandated by POFA 2012. There will be no admissions as to who was driving and no assumptions can be drawn, nor was there an agreed contract. Your signage fails the test of 'large lettering' and prominence of the parking charge, as established in ParkingEye Ltd v Beavis, which is fully distinguished.



Should you fail to cancel this PCN, I require you provide the verification code for POPLA appeal. I refer you to the consequences of Halsey v Milton Keynes General NHS Trust (2004) if you refuse to consider an application outside your normal deadline. I will also require with your rejection letter, all images taken of this vehicle & the signs at the location that day. Do not withhold any images or data later relied on for POPLA/court."

My letters to QDR & Ethical have been completely ignored. I have received further automated letters from QDR advising that payment is overdue, our client may seek a CCJ, etc etc.

I believe I have valid strong appeal points around the signage (lack of it, forbidding notices, doesn't contain certain information) and the timeframe of the notice to keepers.

I have two questions:
1) What should I do at this point, especially as the PPC are ignoring my letters?
2) The companies continually send a separate letter for each ticket. Is it acceptable to reply using one letter with several reference numbers?
EDIT: 3) Who should I be writing to with my rebuttals?

1) keep replying and rebutting like you are doing and have done already

2) yes you could do that , no reason why not, or include all the rebuttals in one envelope, with a separate pcn ref on each one

I think you need to first work out "WHICH" company you are dealing with

ethical parking managemet company number 05024823

or

ethical parking /one parking/think of a new name this week/think of another next week company number 05992210

there have been numerous reported claims of the closed down / dormant company trying to obtain payments via zzps and indeed by zzps using qdr letterheads

note: the address on the ethical letters is a central address for all there active and dormant companies , you need the company number

Thank you, I will do.
The events range from Dec-2013 - April-2014. So there's still over a year for them all.

Owned by {Edited by forum team} and run by {Edited by forum team}. Concentrate on East and West Sussex. Has been renamed a number of times and was formerly called Ethical Parking Management Ltd. Not to be confused with another of {Edited by forum team}'s company called One Parking Ltd which was an IPC member and used Capital to Coast as a trading style.

Prior names were V M Parking Ltd, Allied Parking Management Ltd, Guardian Parking Management Ltd. There still is another Ethical Parking Management Ltd within the group but this has the company number 05024823. If you have had a ticket from Ethical check the company number.

An interesting point, and the answer is neither. On these letters, Ethical give a company number of: 05039198. Companies house list this as "Ethical Group Limited", and as active.



(Side question: if the company were dormant, what would that mean for one of these cases?)

Ethical Group Limited have never been a BPA or IPC member

I have tried to outline what has previously been reported


if the company that issued the charge is trying to gain money whilst dormant , they need reporting to companies house

ethical are doing a "mopping" up exercise on all there dead/deceased companies

Further to post 3 above; the current company called Ethical Parking Management Ltd is dormant and in fact has never traded.

you are being conned with multiple names and confusion , you can see from companies house that



are a dormant company

the company number quoted is incorrect for this company

the company that is now begging , is the holding company for (possibly) a dormant company

NO they are not allowed to collect for a dormant non tax paying company

ethical group did not issue the charge , why the hell have they got info from a completely different company

i would say complain , but most of his companies have been booted out by BPA/IPC
