Is this a Letter Before Action?

Hello all,


After receiving a PCN from Civil Enforcement LTD a google search brought me here and I am glad it did.

I am new to any forum but I did read newbies threads with my best ability to understand all the information.

Civil Enforcement Ltd sent me a PCN which stupidly I was going to pay but thanks for Moneysavingexpert.com advice I appealed at POPLA.

My appeal has been declined by POPLA and Civil Enforcement Ltd sent me this letter.

Can anyone have a look and confirm if it is a Letter before court claim?

All this happened when I took my son (who is severely autistic and non-verbal with mobility needs) to our local library.

According to Civil Enforcement Ltd me entering and exiting the library car park the total time of stay is 26 minutes only.

As I stopped and parked my car due to change or environment my son had massive sensory overload. It took my some time to get him in wheelchair and get to library entrance. He totally refused to enter into the library.

All library visitors are supposed to enter their car registration on a Tablet provided inside the library by reception.

There was no way I could leave my son unattended. I had to leave the library and go back to my car and leave the car park.

Library assistant manager has provided a letter stating that I went to library and parking fine should be waived.

    POPLA didn’t care about the letter even though the Library is run by Birmingham City Council and council the landowner didn’t have any problem.

    Write to your local councillor and get them involved. That is what they are their for.

    As regards any "debt" letters, just file them. Come back if you get anything from a solicitor or a court but see if a Councillor will do something at the same time.

    Is this a Letter Before Action?

    Sadly you haven't shown us the letter or told us it's contents so nobody can say.

    I suspect it isn't one as you get reams of debt collectors letters before an actual LBC and you haven't mentioned those.

    Take a look at the thread at the top of this board that tells Newbies to read it first.

    Post 4 in that thread deals with debt collectors. Post 2 contains information about the court process.

    hosting site and show the link here using hxxp not http
    Someone here will convert it.

    POPLA is now a white elephant which was set up by
    the BPA.

    CEL is a scammer approved by the BPA ?

    Date of Incident : **/07/2018.
    Site Detail: Small Heath Wellbeing Centre, Muntaz Street, Birmingham, B10 9RX.


    We refer to the parking charge notice detailed above.

    We have been notified by POPLA that your appeal submitted to them has been unsuccessful. A confirmation of this was also sent to you directly by the POPLA them.

    Following POPLA’s decision we are now writing to inform you that we are not able to accept any further appeals for this Parking Charge Notice and payment is now due within 28 days from the date of this letter.

    In the event that payment is not received, we will have no option but to issue proceeding against you to recover the amount due to us. We will add our additional costs, Interest and fees to the clam. Payments can be made online on (***CEL website) , by calling 0115 822 5020 or by sending a cheque to Civil Enforcement Ltd, Horton House, Exchange Flags, Liverpool, L2 3PF.

    No I didn't receive any other letter after losing at POPLA apart from this letter.

    You have not received a Letter Before Action.

    You can safely ignore that letter, but keep it and file it.

    Read post #4 of the NEWBIES FAQ sticky thread for guidance on how to deal with the inevitable debt collectors letters.

    Post again on this thread if ever you receive a real Letter Before Claim or official court correspondence.

    That isn't a LBC. It's nothing even approaching one. They will normally leave you in no doubt as to what they are.

    They will soon start bombarding you with letters that are not soft, strong or very, very long.
