Read up in the Newbies faq thread on the futility of appeals to IPC companies.
After sending the initial appeal you wait and see if they progress to a court claim, ignoring the debt collectors
If it comes to a court claim then come back at that time for advice on defending a claim
Take your proper council ticket issue to pepipoo for best advice. This forum majors on private parking charges
What sort of ticket is your other thread started today regarding?0 -
Thank you. The other thread is a Council issued ticket. Two of them in an area which is (supposed) to be allocated parking for businesses on that road.Do not give in to Private Parking firms. Fight them all the way!0

Ever more reason to be aware of the parking signage and what it says. Long gone are the days of dump the car anywhere and assume it can be done with absolute impunity.
There's almost always now someone (public or private sector) looking to take ££££s out of your pocket.
The sooner the Great British public gets the hang of this, the sooner the parking sectors go bust. But legislating against ongoing stupidity is impossible, so much so that the parking sector will continue to profit exponentially. Buy shares! Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

There is no Signage'. There are double yellow lines on the road, and next to ithe road s an area of hard standing. That's where I was parked. I actually have two separate documents from the Planning Committee stating that the hard standing area is an allocated parking area for businesses. One of them is viewable online. No part of my car was on the road way, it was parked on the hard standing and it can clearly be seen in the photographs the Traffic Warden had taken.Do not give in to Private Parking firms. Well I have dancing around with these idiots for a few days now. They are ignoring my questions. They state that the car was obeserved by the landowner parking on this car park on a Friday at 18:30hrs. I asked for proof. No response (although it could be they simply don't need to prove this?) .
I have asked for the name of the Area Manager. Just the name. Do they need to supply this? They are ignoring that query. If it's who I think it is. He's a very naughty boy.
I was wondering though. The vehicle was parked during the closing hours of the business in question anyhow. The Cafe was closed. So how could I have been a customer anyhow?
Personally I would think that was a good defence myself!Do not give in to Private Parking firms. Fight them all the way!0 -
Well it's been a while. Many thanks for all of the wonderful advice received regarding this Parking Charge. I am delighted to announce that after BW Legal had piled £110 of extra fees onto the charge, I reported them to the Solicitors Regulation Authority. A few months later after the SRA acknowledged that I had good reasons for the complaint and it warranted further investigation I received a Letter of Discontinuance from BW Legal. I guess they couldn't afford to loose in court, yet again, for an Abuse of Process.Do not give in to Private Parking firms. Fight them all the way!5

Well done, and thanks for letting us know.
Would you mind posting your complaint to the SRA and their reply as this could be useful to other posters?

Well done Norfolk_Boi, we'd love to see what you wrote and what the SRA Interventions Team said, and the reference/name of the SRA contact, so we can add to these complaints like we have with Gladstones.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
