  • I'm sick and tired of receiving these sorts of letters now. I know through reading the forum I need to not respond / ignore (obviously read with more attention to detail) but they do make me worry :o

    Hi all,

    Following the letters from UKCPS and DRP, I have now received a 'Claim Form', which looks very official with 'the county court' logo etc.

    I have reverted back to the newbies thread for the next stage advice on post #2. Regarding the 'Letter of Claim' it says a 30 day deadline and mention of reply forms. I can't see 30 days on my letter, but there are reply forms. Unfortunately the example letter in the linked post is no longer available. So I have uploaded a letter here

    So I'd like to check the next step is:
    • To do the SAR.
    • Respond but not use the 'reply forms', so write my own letter which is addressed to the PPC as I don't think they are using a solicitor.

    One bit of additional evidence I have, is an email correspondence from the landowner to the businesses on the land that the private parking company will be in place and there is a short time limit before they take action. From the time stamps in the pics there is no evidence of the 'entry' and 'exit' times to determine if 10 minutes had passed. Maybe the information from the SAR would help this?

    Am I missing anything else here?

    If you have received a County Court Claim Form, you are past the point of responding to a Letter Before Claim.

    What is the Issue Date on your Claim Form?

    Did it come from the County Court Business Centre in Northampton, or from somewhere else?

    Yes you should be sending a Subject Access Request to the parking company.

    Hope you're well and thanks for the reply! :)

    Oh perhaps I have got something wrong. My story to date:
    • Received a NTK through the post and responded with the template letter.
    • Received requests from UKCPS to pay.
    • Received debt recovery letters from DRP and Zenith

    Now received the County Court claim form. Issue date 3rd of June 2019 (though I received it when returning from out of the country). Yes it has came from the County Court Business Centre in Northampton.

    Now received the County Court claim form. Issue date 3rd of June 2019. Yes it has came from the County Court Business Centre in Northampton.
    With a Claim Issue Date of 3rd June, you have until Monday 24th June to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox file linked from post #2 of the NEWBIES FAQ sticky thread. About ten minutes work - no thinking required.

    Having done the AoS, you have until 4pm on Monday 8th July 2019 to file your Defence.

    That's nearly four weeks away. Loads of time to produce a perfect Defence, but don't leave it to the last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defence received". If not chase the CCBC until it is.
    6. Do not be surprised to receive an early copy of the Claimant's Directions Questionnaire, they are just trying to keep you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of the NEWBIES FAQ sticky thread to find out exactly what to do with it.
