Car reversed in to me, driver claiming I drove in to them :S

I never drive in to a bay UNLESS it is a very quiet place, it is easier for me to set off in the direction of entering in to a bay. Otherwise, I always reverse in to a bay and park my car right on the edge of supermarket car parks to avoid all this.

Same thing happened in an accident outside our house - the young driver pulled out onto a main road which caused another driver to swerve and collide with another car.
The driver at fault initially admitted her mistake until her Dad turned up and got her to change her story, blaming the driver who had to swerve (or T-bone her car) because 'he had been speeding'.
This was despite having a bus-load of witnesses who had all seen her make the dangerous manoeuvre.
lesson is dont try to be colin mcrae and try to swerve out of a situation like this. by trying to swerve you make it even more dangerous and hit other people like a motorcyclist whose riding beside you.
by all mean hit the brake but drive into these pillocks if you have to. so you dont end up in a insurance nightmare where you become at fault0 -

Do you have actual photo of damage? if this drawing is actually correct then its amazing the insurance company are pontificating over this. reality is a bit more grey than that. if the damage is at an angle then its not clear cut.
playing devils advocate here.
you could turn in and drive into a lamp post and damage your wing for instance.
quarter panel damage does not automatically mean you were driven into.0 -

For most of us, the swerve would happen before our brains kicked in - if something appears in front of you on the road, very few of us would be able to drive straight into it.
In this case, the driver taking avoidance measures hit an empty parked car rather instead of T-boning a young mother and a baby.0 -

The damage is deep in to the door, wheel arch and surround areas, as in something has gone in to it, not scraped past etc.
If I did drive in to this car, how can the damage be on the rear left side? There should be damage on the front left side of the car too. I passed the vehicle almost, and then the vehicle reversed in to my left side. They were in the bay as I was passing them. Hence why no damage on the front left side.
The damage is deep in to the quarter panel, door wheel arch etc. It shows point of impact, then scrapes towards the rear of the car near to the rear left side light, as my car was progressing forward.0
