59 in a 40 the guy is a moron and obviously shows no remorse, the decent thing to do would be to take it on the chin like a real man.I hate football and do wish people wouldn't keep talking about it like it's the most important thing in the world0

Indeed, as I 've said on a number of threads on this matter, the prosecution cannot pick and choose which parts of the legislation they'd like to rely on and which they'd rather the court did not linger over. They already enjoy a considerable advantage with the "presumption of service". But that presumption is rebuttable and Mr Beckham successfully rebutted it.0 -

The CPS are afforded many systemic advantages....imagine adding this to their locker "well, we knew this guy was a wrong'un, so we just changed a few bits and bobs regarding the rules and yeah we know it's not entirely with legislation, but he's a wrong'un. GUILTY GUILTY GUILTY!!!!". They're already absolute villains in my opinion.... about time they lost a case because of their (and the Met's) own incompetence. If we don't follow procedure, we get had..... about time you did as well boys.
All they had to do, was get the NIP out in time..... they failed to do that. Bad luck. Celebrity or not, I'm glad they lost.0 -

Very strange the Met should "forget" to post it in time considering its DB or do they all belong to a certain club by any chance?0 -

Meh.... perhaps. Staffordshire Police certainly didn't forget to post one to me within the timeframe, when I was had. In fact, it appeared obnoxiously quickly.... like it was printed and posted before the camera van had even moved.
My feelings are this.... had it been late, and I had evidence to prove my letter was late, I would have tried to argue that they had failed to comply with their legislation. You don't even need Nick Freeman to know that it's 14 days. You could quite comfortably mount that defence with no legal background. You just need evidence that's presentable and Beckham had people from Bentley and postage marks I assume?
As for the original mistake...... it's possible that you've got a bunch of bumbling incompetent overweight coppers sat in the office eating donuts and drinking coffee, talking about how crime won't crack itself, laughing about the fact Beckham has been had by a speeding fine "oi post this Johnny lad, give it a kiss when you drop it in the box", "yeah yeah will do tomorrow mate, just sending a photo of it to my wife".... Then Johnny decided to take a sick day so his kids could go Alton Towers and the Detective Inspector was buried in all that paperwork and..... tomorrow never came and Johnny only realised he had forgotten to post it when it was too late.
Probably/almost certain not how it went down, but it sounds a great comedy.0 -

They didn't forget. The court heard evidence that DB's NIP was one of 3,847 sent routinely on 2nd February, in time for delivery on or before the 6th. The judge was satisfied that it had been delayed in the post and said ' the law allowed for the “vagaries” of the postal system to be taken into account'.0 -

Except the Bentley isn't even registered in DBs name anyway as it is a lease car, so it would be more "Caught another Toff!" than "Look who we've caught this time!"I want to go back to The Olden Days, when every single thing that I can think of was better.....

Yes, almost certainly not. There were 3,500 NIPs sent out that day, probably with little or no human intervention.0
