UKPC and SCS - County Court claim form
Comments

The named Defendant must attend the hearing.
You can also attend ad speak on behalf of the Defendant - as a Lay Representative.
The Defendant can be asked direct questions and should of course answer truthfully.0 -
ok sure, I guess my wife has to bite the bullet. she's scared going to court, she thinks she's going to jail

so any pointers or how can we defend this case and win?0 -
KeithP is on line and I am sure he will post you a link to a short video explaining the small claims court process to show how "not scary" it is.0
-
ok perfect thanks. That would be very helpful.
Does anyone have any links to a similar case and if they've won?0 -

It's not a criminal case, it's a civil dispute over money allegedly owed to the claimant by the defendant, the judge will decide who owes what and pass that judgment, so if she loses she pays the judgment in full, promptly to avoid a CCJ and avoid her credit rating from being trashed
Her defence is already in, so now she writes her WS which is her account of the topic so far, also adding in her evidence, by the date set by the judge, as directed by the judge, and do not miss the deadlines plus copy in the claimant etc as well as the court
It's too late to alter any defence0 -
yes I've done all that, but if anyone could kindly look at their witness statement to see of any flaws and see who's case is most likely yo win. I would be much grateful. My wife and I are amateurs in this has the kind advice.0

The volunteers here are also amateurs and only offer free common sense advice
This is a consumer rights forum, not a legal aid forum and you won't be getting free legal advice from here, nor will anyone study your case and make a legal determination of your case
We leave that to paid lawyers if you choose to employ one at great expense to yourself, which is what Martin Lewis would tell you to do
The advice on here is read other case threads, common sense procedural advice and advice on any restructuring and wording etc
If you are expecting a free legal service then you are in the wrong place, especially if you expect us to determine the odds of winning the court case
We thought Barry Beavis had a good case and he lost 3 times in 3 different courts
Court is a lottery with Judge Bingo and some cases win that shouldn't and other cases would seem to be a slam dunk and yet they fail
Stick to following procedures and leave the speculation to the press
PS, you have already been given good advice by a professional on what the WS should write back on page 2. A WS is a person's own account so nobody here would know anything about it as they weren't there and have no knowledge of the facts0
