  • What car do you have? Cars with accident tracking locators (many fords, all BMWs etc) will have a GPS location for them. You can simply do a Data Protection request and prove where the car was... All cars sold in the EU will soon be required to have this... Albeit the UK may not be in the EU soon

    I’ll speak to DVLA now, just to confirm when speaking to them should I say the same thing as the advice you gave in the post you linked me previously

    “You need to complain to the DVLA that this parking firm appears to have misread the number-plate of the car that WAS there, and obtained your data in error. Or, your number-plate really has been cloned. Either way, the DVLA need to explain why they gave out your data for an incident that did NOT involve your car.

    I’m struggling to understand what I’m meant to say to the DVLA? As I haven’t requested a POPLA or IAS code.

    Am I just informing them of the plates being cloned? Same with the BPA?

    Dear DVLA and BPA,

    Issue re - cloned plates - VRN xxx xxxx and UKPC obtaining my data wrongly

    I have just had a letter through from UKPC about a parking charge from 12/07/18 from a car park I can categorically say I was not at and have never been at in my lifetime. I have texts from my partner at the same time and date confirming I was in my parents house looking after it while they where on holiday.

    Upon closer inspection of the pictures issued by the parking company I have noticed that the screws that hold the number plate to the car pictured are in different places than on the number plate of my car, also the quality isn’t the best but I can’t see any postcode or company name on the pictures on either the front or rear.

    Also 3 days after the parking event that wasn't my car, I was also pulled by police in a matrix van on my way home from shopping.

    They told me they had been briefed that morning that the car was reportedly on false plates, after a talk with me and checking the vin number they confirmed that my car was legit and not stolen or on false plates. At the time I didn’t think anything of it as police pull me quite frequently due to the type of car being stolen often and my young age.

    BPA, how do I get this removed by UKPC, as I can't really 'appeal' as it's not my car?

    DVLA, what can you do to resolve this, a flag on my data not to release it due to the VRN cloning? Do you need an Incident Number from my local Police?

    Yes it is useful evidence - anything showing you were elsewhere is, and if it comes to it your partner should make a statement confirming.
    Speak to the police and see what further info you can get from them, you're right that it's odd you got stopped and what they said.


    Write to the PPC now, making it clear that it's a case of cloning, that you were elsewhere and have evidence in the form of messages and an independent witness that you were elsewhere (x miles away), and pointing out the clear differences on the photographs between the other car and yours. Tell them the DVLA is now aware of the issue, as are the police (and you believe the police were previously aware of the other car) and they must immediately cease processing your data and passing it on to third parties.


    Every time they/debt collectors write to you, send the letter again referencing all the previous dates it's been sent to them. with each new letter ask them not just to stop processing and retaining your data, but to cease their harassment of you. This sets you up to claim costs for unreasonable behaviour if they do try to sue you. Plus a data protection and harassment counterclaim.

    I have sent emails to both the DVLA and BPA stating what Coupon-Mad has told me to say.

    I also went to the police this morning and told them about the incident, who where able to pull the car up on ANPR and confirm that it is a cloned number plate as it was seen in various locations that day. The officer I spoke to was very helpful and gave me his email and contact number to pass to the DVLA and parking company etc and he said he will confirm the false plates. So I added that into the emails.

    Am I right in thinking I should not contact UKPC until I have heard back from DVLA or should I contact them now stating the same things I said to the DVLA?

    It may be worth speaking to the Sensitive Casework Team at the DVLA - they can arrange to re-register your car at no cost to yourself if somebody has cloned your plates.
    This is not an uncommon occurrence with vehicles on the fleet that I manage.

    As for UKPC - I'd be inclined to send them a letter explaining what is going on. It's more than likely it will end up being passed to DRP rather than a court claim, but every document you have can be used against them at a later date.

    Just had a reply from the BPA..

    “Dear Mr ,

    I can confirm that UKPC Ltd are a member of our Approved Operator Scheme which means that they are required to adhere to our Code of Practice. Should you wish to view our Code of Practice, this can be found using the below link:

    Our role is to investigate any complaints about alleged non-compliance with our Code where evidence can be supplied. However, the BPA is a membership organisation and we are not set up to deal with disputes from the general public about parking, nor can we cancel or suspend Parking Charge Notices. Therefore, the Code does not provide a way for a driver to challenge how a landowner or operator has applied parking control and enforcement on private land. Any challenge or appeal is a matter for the landowners or operators procedure, with the option of taking it to POPLA, and or the courts. The BPA will not get involved in the arbitration of a dispute between an operator and an individual.

    As UKPC Ltd are BPA members, they do have an appeals process so I would recommend contacting them with this information so they can assess the situation.
