  • Got notification, the first 2 appeals rejected from ParkingEye.
    What do I do next?
    I'm guessing I should wait 26 days and appeal to POPLA.
    Grounds for appeal?
    Not overstaying the alloted time not listed as breach of terms and conditions.
    Conflicting signage. One sign displays the penalty as £100. The rest - £70.

    Any advice much appreciated.

    Why the delay in appealing to POPLA?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • I have reviewed my email and find I have actually received all 3 rejections. I missed the first that came in a month ago. The second 2 weeks ago. 3rd last Tuesday. Oops! I've missed the POPLA deadline for the first PCN.
    Advice please.

    Yes, re-read the NEWBIES FAQ sticky thread.

    Post #3 of that thread tells you how to appeal to PoPLA.

    Post #4 of that thread tells you what to do if you get debt collectors letters - which you may do for the first PCN.

    Post #2 tells you what to do if you get either a Letter of Claim of official court correspondence.


    What is the exact date of the first PCN appeal refusal letter?

    They last 33 days max, does the code still work tonight, if so, bung an appeal in soon tonight.

  • It refusal email 4th October. I'll try tonight.
  • The signage is inadequate and vague in wording:
    I have using this car park to shop at this store during my frequent visits to the town over the past 7 years. On many occasions I have remained parked in the carpark after shopping for 2 or 3 hours while attending to other business nearby. For these years I have never been required to pay a penalty charge of any kind. Some time in the last year I believe, the store has engaged a new company to manage the carpark. This company has begun enforcing a strict policy and demanding penalty payments from unsuspecting customers that had not been aware of the company's change in policy. In my own case last summer was not my usual pattern and I spent only a few days in the town. It was not until this summer that I became aware of the change of the carparks management, when I recieved word from my elderly mother that i had recieved a number of ugent letters. If I had been a normal resident of the town I would have found out the situation within a few days and would have been able to avoid further transgressions which occurred two more times in a period of 10 days. I informed the land owner of this in email appealing for a cancellation of all or some of the charges and they have refused. The land owners refusal I submit makes the charges exhorbitant and unjustified. I therefore submit that the signage is inadequate since having visited the car park on dozens of previous occasions, I had no reason to read any of the signage and noticed no difference. In this case for the signage to be adequate there would need to be a specific very prominant warning to regular customers for at least a year, informing them that the situation had changed.
    The wording on the signage is also vague and does not give a clear list of terms and condition that include overstaying the alloted time.....

    I'm posting the above now so there is time for feedback while I keep working this which has to be submitted tonight...

    that is a witness statement, not a popla appeal

    read post #3 of the NEWBIES thread to see examples of good popla appeals

    popla appeals are based on legal points only, popla wont be interested in anything that is non-legal, they definitely are not interested in the back story

    That is NOT a POPLA appeal. STOP.

    The code will stop working on day 33 so copy another long ParkingEye POPLA appeal from any recent thread and swiftly add on your evidence of the signs where one says £100 and one says £70, and put that in a first point in your own words, stating that ParkingEye have filed to properly sign the site and there is no certainty of terms/charge at all and it looks like they've left old signs up.

    Then the usual template stuff (don't ask what that is...the NEWBIES thread post #3 tells you!). POPLA appals here are copy & paste!
