    POPLA DECISIONS is the top thread , check the thread 2 threads below it, that tells NEWBIES READ THIS FAQ and authored by coupon_mad

    its the third thread down, not the top one

    then read post #1 of that correct thread

    ie:- get used to navigating these forums

    you can get it all redirected to anywhere that you can pick up mail, and "address for service" , but maybe not the DVLA docs as they should be your permanent residence (not your mums)

    so one of your main issues is to stop any paperwork going to your mums, plus you dont want court papers or bailiffs going there either - she is not involved so its down to YOU to get that mess sorted out , like coupon_mad said above in her post

    your van , your responsibility , your errors, sort them all out

    you really need to get up to speed on this , otherwise you will be in a world of trouble, even more so if you dont get that paperwork trail sorted out and stop your mum being pestered

    even if they go to a CCJ , your attitude is "it doesnt affect me"

    maybe not, we are fine with that, but it WILL affect the people at the address where all those papers and CCJ,s will currently go

    check with the DVLA themselves about how you can legally register your van away from your mums, its simply "not good enough" to just leave the paper trail pointing at old addresses

  • Please be patient. I'm doing all this on a tablet. And three different forums....
  • 1. No golden tickets. From what I have read, it seems pointless to not admit to being the driver since PE refer to Freedom of ... Act. However, I will use the template suggested.
    2. Yes I am within the 28 days. I have appealed the first PCN already having heard about it only the day before the deadline for discount payment, thinking this would keep the option for discount payment. I know now this is not the case. The gist of this appeal was "You must be joking - it was a Sunday and the store was closed". This was all before I had a chance to start looking at these forums and before I knew about the other PCN'S.

    Can you get a photo of the signs in the next week or so - it could win your POPLA appeals if this is a place where the signs only offer a contract during store opening, and say 'no parking' after that.

  • Does anyone know if a P.O. box address is sufficient for the DVLA?
    Aside from that my plan is to rent premises for a small business I intend to start. Whatever that turns out to be it is unlikely to be a normal residential house or flat. If anyone has any ideas about how to handle the DVLA without a 'proper' address, suggestions would be greatly appreciated.
    Rest assured if it comes to bailiffs or court papers my mother will be well out of the picture!

    Could be wrong but I don't think a PO Box is an acceptable address for service of court papers.

    Can't you just use a work address or friend/relative who will pass things to you within days and won't panic?

  • I'll be back there possibly late next week. In the meantime I know the car park gates stay open all the time. Can't remember anything about store opening hour except the usual for customers only stuff. The implication is no parking unless the store is open I guess. Don't quite understand how this makes a difference.

    Was it dark when the car was parked? Take photos in the SAME LIGHT conditions.
    The implication is no parking unless the store is open I guess. Don't quite understand how this makes a difference.
    It wins a case (at court, and maybe at POPLA if explained well to their not-well-trained motley crew of staff), because 'no parking' means there is no contractual offer, no parking licence granted, and therefore no 'breach of contract' by parking.

    If the signs say 'no parking' then the terms on the sign do not apply after the time stated, and parking is banned after that, so can't also be offered for £70.

    It could be argued to be trespass, but ParkingEye cannot recover monies under a head of 'damages/loss' or the tort of trespass, because they are never the landowner. They are a parasite firm, utterly pointless in life and just bullyboys against motorists.

    IMHO their methods and especially ANPR in the hand of private firms, should be illegal.
