Thanks for all the replies. To clarify some points. As noted above, the single quotes around the word 'client' should be self-explanatory: not a client in the normal sense of the word. In my case it's a relative I'm helping out, and no, I'm not from a parking appeals firm! John Smith? Correct. It's not my real name. Well spotted. Who is daft enough to use their real name on a forum such as this? A f*** off letter? Well I'm not using those actual words. As pointed out above, it's lawyer-speak.
The case - it concerns P&PM, and now Gladstones. In the letter I'm citing various similar cases where the judge has thrown out the claim. Thank you all very much for the links to some cases. If necessary, my 'client' and I will attend court and at the very least will present a copy of the lease.
Incidentally, the original case I had in mind was this one mentioned by Fruitcake:

Perhaps I could ask for one more bit of help … again, a while ago I recall seeing a breakdown of PPCs and the number of cases they've taken to court. Unfortunately I can't find it. Just wondering about P&PM's record. Thanks again.0 -

Clearly my post at #4 is either lost on you or you are choosing to ignore quoting facts/law. Even the Supreme Court in the Beavis case pointed out it was case/fact specific.This is a system account and does not represent a real person. I am with IamEmanresu on this. The bit where he signs off about “If you want to win, avoid losing first” is particularly apt.
That is why I pointed you in the direction of the witness statement which I drafted. You need to come up with a defence along the same lines.
I know from personal experience that, whilst on occasions they discontinue at the last possible moment, they sometimes send a barrister along to greet the defendant.
So, hope for the best, but prepare for the worst. Build a solid defence.0 -

As I was a litigant in person (who won against the barrister), I would not know whether the barrister would also greet the lay rep, but he was a very polite person and I imagine that he would have.

Yes they do, on many occasions when the PPC has sent along a barrister, or solicitor-advocate, to represent them, we've gone off into a conference room to discuss the main issues in the case.Coupon-mad wrote: »Do they also greet the lay rep?
So if, for example, it is agreed that the car was parked in that location on the date and time stated in the claim, there is no point wasting the Judge's time establishing that point.
Usually we can come up with a list of points of disagreement which the Judge needs to rule on, and present that at the start of the hearing, to save time.
