Parking in own space - Gladstoned

My 'client' is up against Gladstones for parking in his own allocated parking space (he parked without his parking permit disk when he was moving in to the property). I remember a similar case from a while ago (not sure of the date) that Parking Prankster cited. Here, the scammers didn't turn up to court but the judge said that even if they had done, they would have lost. Anyone recall this case? I'd like to include it in my f*** off letter to Gladstones. I haven't been able to find it over at PP's website.

    Thank you very much for that link. There's some good stuff and useful references. It doesn't include the particular case I'm looking for - which isn't helped due to my not remembering very much about it at all. As I recall, the judge made a particular reference to the point that even if the scammers had shown up, they would have lost the case. I'll try looking on other sites. Maybe I'm mistaken in thinking it was Parking Prankster who highlighted the case.

    Don't get too hung up on other County Court cases as they may only be persuasive and certainly not binding.

    If you do find a case look for the underlying law or the underlying facts that helped the judge reach a decision and see if they apply to the case in hand. Otherwise don't bother as it will just detract from your case.

    How come you have a 'client'?

    Are you from a parking appeals firm; if so we recommend none and tell everyone to check TrustPilot and don't touch them with a bargepole.

    We also don't help such firms, who tend to rip people off. Who are you from?

    I also imagine that, as the person has an allocated parking space, he/she is the leasehold owner of a flat.


    Frankly, I would not recommend the f*** off approach.


    What stage has the person reached?


    Has a letter of/before claim/action been received?


    Has a formal claim been issued?


    Post the person's lease in its entirety (after redacting any personal data) so that we can see what it says about parking and some other matters.


    I shall follow-up this post with another containing a witness statement which I drafted recently for another residential case. It will not be entirely appropriate for the case which is the subject of your enquiry, but it will help you to get to grips with some of the principles and issues which, fortunately, make it so difficult for parking operators to win claims in residential parking cases.
