Qdr court claim received help!!!

  • Hi Everyone

    I am back again after lodging defence against bank park management ( qdr solicitors). I was hoping that upon receipt of the defence (helpfully drafted by coupon-mad) the claim mag have been stayed! Nope! I have now received directions questionnaire which I have to submit by 10 December and serve On all parties.

    Do I put;
    No mediation
    Agree small claims track
    hearing venue ( i thought bout bham court but decided did not want my personal disputes advertised....so I think I'm going to put Wolverhampton as easier for me to get to)
    Witneses just me
    Although there is no question about paper hearing I know to refuse this.

    Have I missed anything

    As you probably know, QDR are the "bad boys" division of the infamous Wright Hassall Solicitors.

    Given what is happening right now with the fake court claims and the whoopings going on, amazed that Wright Hassall want to get involved again albiet under the "bad boys" name of QDR

    In my opinion, Sir Greg Knight's Bill is the way to go. Judges will have to take heed of the "will of the People" and start dishing it to the scammers.
    You never know how far you can go until you go too far.

    I am most certainly not saying that we should do nothing. What I am saying is that everyone who comes here should be made aware of the possibility that the scam may soon be a thing of the past.

    Despite massive abuse and ridicule from you lot, I am trying to do my little bit.
    You never know how far you can go until you go too far.

    I have concerns.

    It will legitimise the scam, and if PCNs drop to say £50 (£25 for early payment) then more people will pay and less will complain, even if the PCN is a made up pile of crap. And they still will be, in many cases, a made up pile of crap.

    And if the Govt-arranged Independent appeals body doesn't charge PPCs for cases they suddenly offer no contest for, they will be as daft as POPLA who do this and just bleat about it (their fault for not knowing what they were doing and believing the BPA). POPLA actually thought they would be dealing with a few nice gentle appeals about someone not seeing a sign and had no idea about the legalities, and still don't understand the half of it.

    I also have concerns that no disability provisions will be included or that they'll focus on Blue Badge display being the only issue, and completely miss the point about indirect discrimination by imposing a fixed free parking period, or the fact people with mobility problems meed more time for their money (e.g. a free hour extra).

    And I am concerned that the existence of PPCs in Hospitals a residential car parks just needs to be banned outright. No faffing around, kick them all out right now, tear up the contracts and tell them to get lost, like clampers were told - make it illegal immediately.

    Is it this form that I ask for statements to be filed by both sides at the time?

    The form requires me to include phone and mobile number but I don't want them to have that. Can I leave it out as i feel other side will store this and may use to harass me? I can will include email add and other details.

    Phone number - put a row of zeros and see if there's any comeback.

    Email address - of course don't give them your day-to-day one. As you will likely need to interface via email at some stage in this process, get a throwaway Gmail address which you will use exclusively to deal with this PCN.
