Vendor Won't Clear House (Options)

    Slightly left field, but if the vendor does leave his tat, you would be wise to get something in writing about your right to clear it. You don't want him turning up a month later asking where his stuff is ...


    And look on the bright side, there just might be something worth saving. Sometimes, one man's tat is another man's collectable.

    Martindow you totally misread what i said. It isn't that the vendor won't clear the house 'now' it is that he is refusing to clear it at all despite saying in the property info form that he would.

    As above (ad nauseum) before exchange your opinion of the distribution of the vendor's belongings is immaterial.
  • Why should he have to clear his belongings from his house before he has a guarantee you will be buying it?

    He may have had every intention to clear it as per the form, you have probably !!!!ed him off with your unreasonable request and is now going to make things awkward.

    THEN YOU will have to CLEAR it or NOT buy it!!!

    It's up to you, if he says he won't clear it. Buy it and clear it yourself, or don't buy it.

    It will cost peanuts to clear it yourself, won't take long. Might even find some treasures....

    My dad found something like that back in the 1960's... It's now in Yale University Museum!
  • Bringing a small claim against someone is a very simple process. You simply issue a claim through the court's online moneyclaimonline system. It is not the difficult or stressful process that some other posters think it is.

    Personally, I would simply proceed with the sale. After exchange, ask that he clears the house before completion.

    If the house is still full of tat at completion, pay someone to clear it for you. And sue him for the cost of that.

    I'm really not sure what you want to hear.

    Let's recap...

    Is there some way you can force him to clear it pre-sale? No.
    If you buy the property, uncleared, whose responsibility is it to actually DO the clearing? Yours.
    Will you be able to recoup the costs of that clearing from him? Maybe, maybe not.

    So the question is... Will you buy the place, with the probability it will be uncleared, or will you walk away?

    What other options would you like?
  • Steampowered, it only seemed to be £25 to put through a small claims court. Am talking to my solicitor re legal options again on Monday.

    Alternatively, do I have the option to sell it? If he leaves it does it legally become mine?
