EA lied about work been done

Hi everyone I baught a house in April of this year and on the estate agent web page it said it had a new boiler, windows, doors and an en-suite put in with in the last year ( the house was only listed in jan 18). Anyway we move in then I did a bit of digging around and for out the work had been done late 2015 early 2016. Dose anybody think I would be intitled in some sort of compensation and where would I start. Also I’ve still got a screenshot of the EA page with the above mentioned.

    Is this a wind up?

    Estate agent meets vendor in December 2017 and vendor says 'we did this last year'. Translates into what was written down when the house hit the market in Jan 2018. End of story.

  • No. On the estate agents house details somewhere it will say along the lines of:

    'whilst we try to ensure our details are accurate they are not warranted to be so and should not be relied upon as fact nor form part of any contract'

    In other words, you should have checked first.
  • I suspect your agent would have had a disclaimer like most agents when it comes to the details, here is an extract from one agent:
    These particulars are only a general outline for the guidance of intending purchasers or lessees and do not constitute in whole or in part an offer or a Contract.
    Reasonable endeavours have been made to ensure that the information given in these particulars is materially correct but any intending purchaser or lessee should satisfy themself by inspection, searches, enquiries and survey as to the correctness of each statement.
    All statements in these particulars are made without responsibility on the part of agent or the vendor or lessor.
    No statement in these particulars is to be relied upon as a statement or representation of fact.

    You'll never be able to prove the EA lied. They'll just say that's what the seller told them.



    So the work was done a year earlier than you thought? I really can't believe that makes much difference.
  • So the new boiler, doors, windows and en-suite were done in early 2016 rather than early 2017 as thought?

    Did they all work when you moved in?

    Pretty minor issue, I'd have said.

    Surely your solicitor received guarantees, receipts etc from the vendor's solicitor showing when the work was done:cool:
  • Doozergirl chill out I was only asking. Yes they all worked apart from the boiler warranty was void. I no it was only a small matter but Purplebricks messed me around from the start. Also I did not want mega bucks just a little something for them to say we got oi wrong
  • The EA will simply be going on what the seller told them. It isn't an EA's job to verify stuff like that.

    The Estate Agent writes what the seller tells them. The buyer does checks BEFORE they buy to make sure that the property is as described by the seller and suits them BEFORE they pay for it. It is the buyer's job to do the checks by having surveys done and by asking their solicitor to check. The fact that you didn't know that it was your job to check isn't the fault of the EA. You do not get compensation from anyone for a mistake that you made.
