perhaps you may want to read / watch the below ... it will give you a greater understanding re this national disgrace ....

    https://hansard.parliament.uk/commons/2018-02-02/debates/CC84AF5E-AC6E-4E14-81B1-066E6A892807/Parking(CodeOfPractice)Bill

and slightly longer, the committee stage

    https://www.parliamentlive.tv/Event/Index/d5550515-cce9-4185-83ec-754dadb7524a

''Rip-offs from car park Cowboys must stop''; unfair treatment; signage deliberately confusing to ensure a PCN is issued; ''years of abuse by rogue parking companies''; bloodsuckers; ''the current system of regulation is hopeless, like putting Dracula in charge of the blood-bank''; extortionate fines; rogue operators; ''sense of injustice''; unfair charges and notices; wilfully misleading; signage is a deliberate act to deceive or mislead; ''confusing signs are often deliberate, to trap innocent drivers''; unreasonable; a curse; harassing; operating in a disgusting way; appeals service is no guarantee of a fair hearing; loathed; outrageous scam; dodgy practice; outrageous abuse; unscrupulous practices; ''the British Parking Association is as much use as a multi-storey car park in the Gobi desert''; and finally, by way of unanimous conclusion: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists and ordinary residents should not have to put up with this''.

These are the exact words used, so you should quote them to your MP in a complaint and ask him/her to contact Sir Greg Knight MP if he wants further information about this scam.

and some quotes from the committe stage

"The other area is hospital parking, and I want to single out one company for some pretty shady practices. That is ParkingEye"
" is very clear to me that there is collusion between parking companies and solicitors’ firms—so-called roboclaims companies. "
"They are often set up adjacently and involve the same directors and personnel. Incidentally, the same personnel get involved in the so-called appeals bodies."
"Essentially, it is a money-making enterprise that takes advantage of motorists up and down the country. They operate in a very business-like fashion, which is why I call them roboclaims companies."
"The companies are jamming up parts of our legal system."
“I now pretty much know exactly how the parking companies and in particular the IPC have been running this scam for the past 5 years. Basically both of the appeals processes are a complete and utter sham, (and part of that sham is Gladstones Solicitors itself)”
"The appeals process at Excel/VCS is run by a team of minimum wage office workers with no legal knowledge or experience whatsoever,"
" It is claimed by the head of the appeals service (retired Judge Bryn Holloway) that this is a completely independent fair process, it is not”
"The letter mentions two individuals—Will Hurley and Bryn Holloway—and concludes this is a typical example of the clear collusion between the IPC, their members and the IAS"
"what we can do about roboclaims companies and solicitors firms that profit, often in shady ways"
" the very large amounts of money that can be involved in such scams—a company called Smart Parking was involved in one such scam on my patch"
"tightening up the rules regarding the unfair use of automatic number plate recognition" "BW Legal, regularly issues 10,000 county court judgments a month, and is known to have issued 28,000 in one month"
"They are jamming up our court system, and are often totally unjustified."
" because the lifeblood of trying to extort money from people is having access to their details."

All from Parking (Code of Practice) Bill (First sitting) Hansard

As before, you haven't been fined, you've been what's known as double dipped.
As part of their contact with DVLA, and the GDPR (former data protection act) company's must ensure their data is accurate.

Asda are responsible for the actions of their agents, you should be making a very strong complaint to asda, you should also remind/inform them of the inaccuracies inherent In anpr technology.
As a result you will be making a complaint to the ICO over the mishandling of your personal data, and you expect ASDA to remove the inaccurate ANPR systems with immediate effect, as provide you with evidence that they have done so.

So a quick update on the parking charge situation

Ranging the store this morning speaking to the store manager about the issue, after going back and forth with him being very sarcastic about the situation and practically being called a liar over the phone, then reassuring him all evidence the car was not in the car park in the time period it acquired the " fine " a meeting was arranged. Fast forward to this afternoon, arriving at the store for the meeting and presenting all evidence that the car was not in the car park during the time period. After reading through all the evidence and looking at the times via a mobile banking app he then apologised saying " I'm not allowed to give an answer to if you were or was not in the car park at the time down to data protection because if I said it was not in the car park it would land myself in trouble " which is slightly understandable. After laughing that he could see my dog in the first image he apologised again and said " i will get the fine squashed for you ".

Asking him what happens next he went on to explain that its very simple on asda's behalf, the store manager logs on to their client website fills in a very short form taking max 30 seconds and it will remove the fine and a letter should arrive soon stating the fine has been removed.

questioning the reliability for the ANPR camera for faults or down time, he said " that the camera must have missed the car leaving the first time and connected both visits into one " also mentioning that he has had to cancel a fine in the past due to the same issue, then attempted to reassure that the camera works " just fine" and to be careful in the future making sure that the camera can capture the plates as the car leaves

After thanking him for this, a drink was bought to prove at the moment in time the car was in the car park as a customers car just in case he goes against his word.

what is shocking is that for asda it is that easy to go and get a fine removed with so much ease but wont do it for many people.

Maybe not an outrage haha but I've been shopping their for years and never had an issue, if the car was left there the fine would be paid but the fact is the car was about 20 miles away
No, it wouldn't. Eeek! Course it wouldn't. It's an outrageous scam.

Don't even type that here, it's like a swear word on this board!

No-one on this forum PAYS a scam PCN even if 'the car overstayed'.

Yes they do, Supermarkets cancel these all the time, it's normal and doesn't need 'a meeting' and being viewed as a liar.

You should wait till PE confirm it's cancelled then complain to Asda Head Office, for how you were treated. This was bad customer service by Asda who really can cancel in seconds and lied to you about it being 'data protection' which not even the CCTV was (because it was of your own blinking car!).

I can't believe I just read that, how does this complete muppet expect you to do that, why should you need to, and how does he propose to inform all his other customers how to avoid errors from their fallible system?

And it still isn't a "fine"!

Asda managers (not Customer Services frumps) have direct access to the PE system which monitors their car parks and allows cancellation at their fingertips. This was confirmed to me by an Asda manager when I got directly involved in trying to help out a customer who had received a windscreen PCN from a PE foot soldier (exceptionally unusual).

It soon became obvious why he was there - Bank Holiday Monday a year ago, lots of traffic - an opportunity to make a killing. Have never seen him there before, or since, likely to have been parachuted in from some distance away (non-local accent).
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Oh a complaint will he made to head office about the situation, Its wrong they can talk to paying customers like that and then apologising for his mistake just took the mikky in my eyes. The data protection phrase will just have been used by him to attempt to not dig the hole any deeper. At the end of it all, we have his name and proof he has sent the " form " off even though its most likely a click of a button

He actually explained the process to be after our " meeting " ( not sure how standing near the freezers was a meeting but hey ho " that it was a very simple procedure a small form online and a few clicks but then was aided by " I only have had to do this once or twice before " all said while laughing, Knowing full well he was just unloading a load of bull.

I just visited a Supermarket today, and the parking voucher would not validate and the images did not show my car arriving.

The message suggested I faff about queuing up at CS. I think not...

I was in a group of family, and the driver will not be identified, of course! :p

I was there an hour and have a valid parking voucher. Never had my car not seen by the cameras before. I know it's common but they've got me now, LOL, what fun!
