  • Thanks again for response. It says on the letter that I’ve lost the right to appeal now so do I still appeal anyway? It says to put any exceptional circumstances in writing but I’ve read on here to fill online appeal forms in instead but I’m not sure they’ll be one if it says I’ve lost right to appeal.

    Also, if I do appeal and it will more than likely get disregarded- what happens next?

  • You appeal to show you have been reaosnable. Yes, you appela as directed so if the online page wont work, just email or post (first class free proof of posting, no other method) to them

    Re PCN number:

    I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement. There will be no admissions as to who was driving and no assumptions can be drawn.

    Since your PCN is a vague template, I require all photos taken, a clear image of the signage and an explanation of the allegation (e.g. if you have identified a wrong VRN input at a machine, say so, and explain why your Data Protection Officer has not simply rectified it, rather than trying to punish a driver for a matter where there is nothing to deter).

    I will be making a formal complaint about your predatory conduct to your client landowner and to my MP, appraising all parties of the debate where Parliament agreed: ''we need to crack down on these rogue companies. They are an absolute disgrace to this country. Ordinary motorists...should not have to put up with this''. Firms of your ilk were unanimously condemned as operating an 'outrageous scam' (Hansard 2.2.18). The BPA & IPC were heavily criticised; hardly surprising for an industry where so-called AOS members admit to letting victims 'futilely go through the motions' of appeal and that 'we make it up most of the time' (BBC Watchdog).

    Should you later pursue this charge by way of litigation, note that service of any legal documents by email is expressly disallowed and you are not entitled to assume that the data in this dispute/appeal remains the current address for service.

    Can somebody also please explain what the VRN bit is please, is this relevant to mine? Also, I don’t understand the email but at the end- do I need this if I’m not writing by email?

    Yes if you like, replace the 'wrong VRN' sentence in brackets, with it.

    But you already know it will get you nowhere so no need to spend much time on appeal, as you were told months ago:
    You appear to have missed the fact that NO APPEAL WORKS and you will win in court, in the end. By all means send AS Parking a COPY of the PDT (and they WILL reject any appeal) but keep the original until the court claim - and win then, with our help later.

    That's the case with all IPC firms, and that's why we encourage complaints to MPs, and why Parliament called the entire operation an ''outrageous scam''.

  • Quick update- I put in an appeal as keeper using the online tool and they have replied saying I have missed the opportunity to appeal as it is a strict policy on only accepting appeals 21 days from PCN ( even though they have ironically totally disregarded the fact they have gone against the day 57 to send NTK!) . They will now only accept appeals for exceptional circumstances as to why I couldn’t appeal sooner. They have provided all the photos I requested per the template appeal letter. What is my next step? Is it just wait til I get a LBC? Is there anything I can be doing to prepare in the meantime? I do need to write to MP still, is this my MP or MP of the town or both? I’ve contacted the landowner and they don’t want to know- they didn’t even email back the second time.

    It is the will of Parliament that these scammers be put out of business. Hopefully that will take place in the near future. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers. Read this one which I wrote earlier

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.

    Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.

    Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.

    All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers.
    You never know how far you can go until you go too far.

    that is correct , although you could send the PPC a SAR in order to get everything they have, send the SAR to their DPO
  • Ok thanks. I’ve just been on their website to look at their Privacy Notice to find DPO details but the email is still their own email, is this ok then? Also it says to provide proof of ID for me, would this be driving licence?
