PCN for incorrectly placed ticket

I received a parking chargeicon Notice on my windscreen on holiday. We had purchased a ticket and displayed it correctly, but it was displayed backwards on the dashboard. I have a pic of how it was which, along with speaking to the next car, suggests it fell forward with the wind as the door closed. Yes, I know we should have triple checked but getting two young children out of the car and raincoats, bags on a miserable wet day we didn't. So we now have a £100 charge notice. I have read on forums to wait for a Notice to Keeper (the parking company is member of IPC not BPA). From my research I think the right thing to do is:
*Wait for Notice to Keeper, which should arrive by day 56
*Appeal, but do not disclose the driver
*Appeal with Independent Agency, as AS parking are likely to deny the appeal


Have I got this right? I do feel quite anxious waiting when I have the ticket to prove I paid so am I better to appeal now? IT does clearly state on their signs that ticket has to be displayed correctly, but it isn't a sticky ticket so Im guessing this problem has occurred quite often.


Also I have private plates which I need to put back on my car- will this effect the parking companys chance of getting details from DVLA?

    No.

    Not IAS. Independent? No chance. This is covered in the NEWBIES thread, 3rd post.

    No, it's pointless and you will blab about who parked the car, and you will not get anywhere. Believe me, this will make you anxious for months yet, before you have the chance to win it in court. Not joking.

    All the time with AS Parking - I think them (and a similar firm, Armtrac) do this for fun, deliberately thin slips of tickets churned out, as robust as a leaf in windy car parks = £100 per victim - kerching!!

    You appear to have missed the fact that NO APPEAL WORKS and you will win in court, in the end. By all means send AS Parking a COPY of the PDT (and they WILL reject any appeal) but keep the original until the court claim - and win then, with our help later.

    That's the case with all IPC firms, and that's why we encourage complaints to MPs, and why Parliament called the entire operation an ''outrageous scam''.

    Have you never sussed the fluttering ticket scam? I carry Blutack in my glovebox to hold any PDT secure, stops rogue parking firms from shaking cars to dislodge the flimsy thing off the dash...ooops...kerching!!

    A very regular problem which the parking vermin loves
    One judge questioned why they don't use adhesive
    tickets to stick on the windscreen, think about that

    AS Parking is a known scammer, how do we know ?
    Because they are members of the IPC//IAS which is currently
    the UK's biggest scam set up by Gladstones Solicitors.

    No point in appealing to a scammer, both AS Parking
    and the IAS as the IAS work for the scammers

    Be prepared to get letters from !!!!!! debt collectors,

    You would need to send your vehicle doc to the DVLA.
    Not sure how long this takes but sooner or later
    AS Parking will get your details based on the reg number

  • I will red these links thank you! I was on holiday at the time so I presume you mean MP of that area? I have emailed the land owner but they weren’t very helpful and say they can’t do anything?! Thanks for your reply.

    The landowner could do something, but can't be bothered. If it was a holiday place, give them a bad TripAdvisor review.

  • I successfully won my similar 'fluttering ticket' case.
    Suggest you link to it and a couple of other similar ESPEL cases that I have helped out with.
    You have done nothing wrong and the parking firm are trying to force you to pay (I felt it was a scam).

    My Suggestion is to appeal to the parking firm and include a copy of the ticket as per NEWBIE sticky. This provides evidence you have tried to follow process if it ever goes to court. Don't expect them to quash it though.
  • Did your case go to court? It was in Cornwall you see in holiday so if it gets to court then it’s actually going to be cheaper to pay the fine than travel and accommodation costs! I presume can claim back actual court costs if I win but not sure about travel/accommodation and time off work etc?!

    If it goes to court, it will be in your local county court.

    That assumes you are a private individual, not a business.

    Better than blu tack is a small, self-adhesive clear plastic clip you can affix to the inside of your windscreen. You just slip the ticket into it and it won't budge. You can find them on eBay for a couple of quid.

    I've just bought a new one for my new car and it even has a blue "P" on it to(hopefully) bring it to the attention of the parking attendant.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    As KeithP says, a court case transfers to your local court, as you are a consumer individual.
