  • You also need to bear in mind that the director of this company has been very critical of the decisions made by judges when they have not gone in his favour. He is not winning friends and influencing with the judiciary. You do need to give them something to work with though.

  • Yes CouponMad I did spot it and point it out, in the skeleton argument though as I didn't have this info when the defence went in.

  • SnakesBellyBut as far as I could see the fee was on the NTK and it's been argued to be reasonable costs before. Then NTK (when I finally saw it as a result of the SAR) appeared to meet the required standard.

    about the fake £60

    There was a recent Gladstones case where they tried the same £60 stunt and the judge said NO
  • Well, brace yourself guys because my date's been vacated and relisted. Don't have new date yet but it will be 'after the 25th Feb'.

    So - now i have to work out what I can add to/change/whatever my slightly mediocre WS and skeleton arguement and yes I'll go and read a load more stuff and will post new date when I get it.

    Seems me turning up in person looking stressed as well with a well evidenced sob story of family crisis actually worked. And as a PP said, the courts are staffed by humans...

    On my Letter before claim from the sister company to VCS there is a specific amount of £60.00 added on for debt collection charges. I have copied the page of DRP website and included in my bundle which states that they operate on a no collection no fee basis. I cannot see how a court will wear that even if I lose the case. I have also added this to the list of unreasonable behaviour.

    Take a look at your Letter Before Claim. and there may be a specific amount added on for debt collection charges. They haven't paid these charges to the collection agents.

  • As always, thanks to everyone for the help so far.

    The postponement of the date helped with being able to get there, didn't help with me being able to do any more prep.

    Completely unprepared for hearing, no time, I know this sounds ridiculous but I promise no-one feels more !!!! about this than me, so, if anyone's able to suggest anything I could do in the 2 hours or so I have possibly available before it happens to feel even vaguely more ready I'd appreciate it.

    Also I've realised I've idea what actually happens. Procedure, opportunity to talk, how to address the judge, nothing. And yes I'll search the forum later but working now so just leaving this here in case anyone has time and pity enough to throw me the odd bone.
