    Did she write pretending to be you, and writing ''I parked because''? HOPE NOT.

    Or did she write giving your name and address as the resident, and wrote about herself in the third person, e.g. ''I am the resident, this is not my car, but the driver came to my flat because''?

    What C-M was pointing out to me is that your case is a slam dunk win. Since we know Gladstones are stupid, I was musing whether you could get any money out of them for your trouble.

    Im just confused as to where i go from here. Do I wait for Gladstone to write back to me after sending email re my information? Is it likely we both will have to go court? And file for a LBCC as the previous person so kindly mention?

    I hope not too. She is checking PREVIOUS emails then will let me know. I have a photo of the signage and it is not clear as my sister just told me she was too short (she is actually)to read all the small prints. even after zooming in form her mobile.

    If you can show you were somewhere else at the time e.g a plane or train ticket, send them proof you were not the driver AND there is no need for you to let them know who was.

    Then tell them to remove ALL personal information from their database as they have no purpose in having it.

    They may then check with the DVLA as to whose car it was but that will give them an issue with timings.

    Are you able to show you could not be the driver?

    Yes, I was abroad for over 1 month. my passport will prove that. And when they obtain her details form DVLA whats the next step? do we appeal and through IAS? Even though after reading a few threads on here they work along time Gladstone. and more likely will reject our request.

    If they then apply to the DVLA for her data, they are out of time to hold her liable in law which makes life harder for them.

    In your dealings with PCM, in extracting yourself from this mess, do not give her name and address as driver. Leave that as their headache to work out/guess and muck up later.

    Send your proof of being abroad, and state that you now REQUIRE them to rectify their error where they assumed you were either the driver or the keeper:

    And also, put cc: the IPC at the top left...opposite your address.

    I sent a formal letter/email today and will post the same to the PCM tomorrow.
