    How long is your piece of string?

    Best that can be said at this stage is 'several months'.

    The good news is that a month or more after you have filed your Defence you get a Directions Questionnaire where not only do you get to choose your local court, you also get to specify dates when you are not available.

    Ok noted, thank you. Please see below the first draft of my defence statement.

    I followed some parts of one of the newbies, Also should I attached itinerary, passport stamp copy to this when sending emails? see below.

    I invite the court to dismiss this claim as I am neither the registered keeper,driver nor was I present at the time in the UK when the incident occurred.

    This claim came to my attention upon my arrival back into the UK on 27th June 2018 for the summer holidays, prior my last visit was in October of 2017.

    I emailed Gladstone Solicitors asking how my details was obtain and that I knew nothing of the claim they are making against me. (please see proof of email dated 28th June 2018). I was anxious to get a respond immediately so I called GSL and they explained there was a email sent (which was not sent by my email address) was claiming the reason for parking with a display permit and the time. Which was done without my knowledge or even authorisation. They then refuse to send me a copy of this email after I requesting proof for myself.

    I sent copies of my passport stamps exit and entry of my last visit to the UK. I ask for them to stop writing to me demanding payment and to remove my name from their database. I also requested they need to get in touch with DVLA to obtain the owner’s details through the correct procedure, again my kind gesture was ignored.

    My question to GSL is simple:

    Why during the 28 days a DVLA POPLA notice was not sent to the owner?

    Why not give he owner the opportunity to clarify if they were in fact aware of the incident or not?

    I deny every allegation set out of your claim
    The defender denies being the driver, owner or even present at the time of the supposed event.

    I believe that the fact stated in this witness statement are true.

    Did you base that on any of the example Defences that can be found linked from post #2 of the NEWBIES thread?

    Is it even a Defence? It says "witness statement" in your statement of truth.

    Nothing gets 'attached' to a Defence. It is purely narrative.

    You need to be reading the second post on that thread.
    That's exactly the same post where you found the Acknowledgement of Service Dropbox guidance.

    I did get my draft from ones of the Newbies thread but put into my own words. Is the wording not good enough to use as a defence? excluding all the proof I noted I may have add to send as a attachment?

    You send no attachments with a defence. You just sign & date & email it to the CCBCAQ email address KeithP gave you in post #42, that I am sure you can see now.

    The NEWBIES thread says when that stage (evidence & witness statement) comes later.

    No, your wording is not a defence, not good enough to win the case and looks nothing like the versions everyone else finds just by reading the NEWBIES sticky.

    Hi Coup-mad,

    Ok I have seen a few which quite detailed and just a bit worried how to word it. Considering I was not present in the country or neither the driver or keeper of the vehicle, my name was use without my knowledge or permission.

    But I will make a second attempt and write another one. Thank you for your effort in trying to help.
