VCS Letter Before Claim - CASE DISMISSED
Comments

Hopefully the manager will do something about it. I should have contacted them straight away, not when I have a letter before claim.
Something I have noticed after more reading on the matter is the time between contravention and issue of notice to keeper......39 days. I belive this falls outside POFA. Do I have to tell anyone who the driver was?
If the manager does not, come back here
None of their business who was driving
Everyone should complain to the retailer or outlet immediately
they get a ticket, it's a very high win rate0 -
I didn't even think to ring them. Came on this forum back in January, saw all the ignore posts and thought nothing else of it. I'll call again later today if they don't phone back.
So the POFA thing is for appeals then?
I'll read it all again...ha...try and make sense of it.0 -

POFA is "Protection of Freedoms Act 2012"

POPLA is an appeals service

Hi, maybe I mis-read back in January or worded that wrong. I felt the concensus was to not contact the parking company and to ignore the debt collection letters. Now I have the Letter Before Claim I'm a little more concerned. I'm guessing that's the whole idea of these companies to make you pay. £160 for my vehicle being in a car park for 17 seems extortionate.0 -
Ignoring debt collectors yes, but not ignoring a PCN. Never mind, no appeal would have worked anyway as they belong to the IPC and there is no fair independent appeals system on offer (IAS is clearly a kangaroo court to any reasonable person's eyes, given the bizarre decisions reported).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Update.....I've spoken to the general manager of the pub. They no longer use vcs so he would be unable to contact them to stop the PCN. He even said he had asked for notices to be rescinded in the past, some were, some weren't. They stopped using vcs/excel as he didn't want his customers being taken to court like they apparently do.
He's also going to try to send me the contract they had with vcs/Excel as he believes they required written permission to start court proceedings.
This may not happen and may not be of any use.
Where do I go next with this one please?1 -
You know where to look, the replies to LBCs, in the NEWBIES thread.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I thought as much. With beamerguy suggesting i come back after speaking with the pub manager, thought I'd update. I'll make a start with that tomorrow. Not too sure what grounds to go with other than 17 minutes is ridiculous, and they haven't adhered to the codes of conduct at IPC.
I'd like to see evidence of signage on the date in question.0 -
