Hi all,
My Daughter and Son in Law recently visited The Range at Havens Bank Retail Park in Exeter,it was close to closing time, as they have a disabled badge they parked accordingly went to read the board about parking, as they both have Mental and Physical health problems they found it hard to understand the charges and if they had to pay.
They popped into the Range then left and departed the car park, this was on the 21/06/2018, on the 7th August 2018 they received a letter from DRP saying pay £160.00 or go to court, they had no prior notice of the parking charge, no PCN from Smart Parking Ltd, I have contacted DRP on their behalf only to be told that there is nothing they can do, so pay up or go to Court.
I have now e mailed the Range to see if there is anything they can do, any advice would be appreciated.

Debt collectors have no powers to do anything and can (and should) be ignored. Please do not contact them again. Post 4 of the NEWBIES tells you why it is safe to do so.

Keep on at the manager or CEO of the Range. Leave negative feedback on social media as well as complaining to your MP.

Also complain to the BPA and DVLA that Not so Smart have gone straight to debt collectors without issuing a PCN/NTK.

Smart parking are just parking scammers

When it comes to DRP, YOU DO NOT CONTACT THEM, they are
pointless timewasters with straw for brains.

Please read the newbies thread at the top of this forum it explains everything about this scam.

Stop contacting debt collectors, they are liars and only interested in taking your money THEY cannot instigate court procedures.

You have done the right thing to contact the land owner, the greedy PPC has no interest in anything but cash!

Like all the other similar cases, please email Steve Clark at the BPA and ask him to add this complaint to the file he promised to start, regarding the pattern noticed on MSE forum about Smart Parking not issuing any NTK, but going straight to DRP letters.

You will need to explain to Steve Clark how come you are acting as the mentor/family representative for the driver/passenger (do not name them) who have disabilities and whilst one of them can drive (do not say who!) making this sort of complaint would be beyond them. You may have to get son/DD to email the BPA to confirm you have the right to email on their behalf (again NO saying who was driving, out of the two of them!).

Give Steve a URL link so he can read this thread.

Forget the complaint to the Range, who (based on lots of posts before) are utterly useless when they get any complaint about a typical PPC scammer.

P.S. Please give the driver some lessons on sign reading. Not joking, They MUST be able to understand parking, fees/tariffs and driving rules or IMHO, they really should not be in charge of a car. I am being honest, and mean no offence. They can't go round driving anywhere then saying 'we didn't understand'.

Why didn't they simply go to the CS desk first, and ask for help or exemption from parking terms?

  • Hi All,
My Son in Law has now had a letter saying that if the £160.00 is not paid they advise their clients to proceed with court action. They ask for him to contact them so a payment plan can be arranged . I have been in contact with the CEO of the Range still waiting for a reply, but won't hold my breath. Any suggestions as to how to proceed
    Thank you

I already told your Son in Law not to bother with the Range, and who to bother with.

If he gets a. Lbcca then point him to the newbies FAQ thread #2 for advice on how to respond.

Obviously don't respond to this latest debt collecting attempt

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
