Hey all,
The letting agent just sent me the below email. I am looking for some advice on how to proceed here. I do not think I should be liable for paying a tenant compensation as they knew what they were renting before committing, and the letting agent selected the tenant, and the council have given me a solution that I actioned. I would like the tenant to leave now. How can I proceed?
Dear Mr ******,
I hope you are well.
Please be advised I have received a written complaint from Mr ******* who I understand met you at the property on Monday, 20th August 2018.
While I understand a temporary measure has been made for the storage of the bin I understand that building works are due to commence in the ********* Business Park in 6-8 weeks’ time which as a result will affect the bin storage.
Mr ******* has asked for clarification on a permanent solution for the storage of the bin and has raised a request for compensation to be made for Mrs ******* due to the challenges placed with the bin.
If you could be so kind to refer back to me on the permanent solution for the bin storage and the compensation request that would be most appreciated.

Yeesh. I'd be tempted to write back to the LA and suggest you'd be happy to accept an early surrender of her tenancy if she is unhappy at the property.0

That is probably the best solution - to offer her the chance to (cost free of course) surrender the tenancy.
I know it wouldnt occur to quite a few people as to there being no arrangements for disposal of rubbish until the first rubbish collection day we looked for them - so it's understandable that she didn't ask about this (ie because she "knew" that there would be arrangements). As she's found there aren't arrangements after all - best to give her the chance to move if she wishes to.0 -
Not quite sure what "compensation" she's seeking - is she saying she can cope with the arrangements after all, if you chuck enough money at her?0

She hasn't suffered a financial loss, so has no grounds for compensation. I think what davidmcn suggests is probably right.0

From what you've said previously you lived there yourself and know that rubbish arrangements aren't ideal. When anybody is looking around your flat, they're trying to work out if they want to live there, they're not thinking about bins - who would be?
To avoid this happening again you or your agent is going to have to mention this to prospective tenants so they know the situation in advance. It will put some people off unless you can sort it in some other way.Make £2025 in 2025

Agree a date for her to leave, she must pay rent up until that date, don't show any new tenants around until she's gone. Don't even consider giving her any compensation.

How far is the nearest tip to take a rubbish bag?
If it is say 5 miles, then offer 10 miles x 40p x 4 = £16 a month then reduce the rent by this.
A whole bag of rubbish a week for a single person is a LOT! She needs to recycle. We don't even fill our swing bin each week and there are 5 of us and to dogs!!Should've = Should HAVE (not 'of')
