I have no issues with attending court and defending the case IF I can actually win. I believe I genuinely have a fair reason not to pay the ticket but if anyone in this forum who has more experience with parking tickets and going to court thinks for whatever reason I will not win the case I would rather just pay a reduced amount and avoid getting the "black list" for going to court and losing etc.
Any thoughts ?
Thanks in advance0 -

No one can pre-judge the outcome, but there is a remarkable success rate for those who the forum has helped right through the process - and where they have stayed with us and followed the advice given. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

There is no "black list". There is a strong suspicion there is a "suckers list" for those that roll-over and pay.
Do you know how many times your details have been accessed by parking companies in the last 6 years as they have 6 years to harass you for payment if you are a "payer"This is a system account and does not represent a real person. To contact the Forum Team email forumteam@moneysavingexpert.com0 -

Hi All,
Latest update - I sent off the N180 Directions Questionnaire filled out as advised. I have today recieved a N271 Notice of Transfer of Proceedings letter detailing:
"The claim has been transferred to the below county court hearing centre for allocation. On receipt, the file will be referred to a procedural judge who will allocate the claim to track and give case management directions. Details of the judges directions will be sent to you in a notice of allocation."
So now I wait for the judges directions and a notice of allocation ? Then to prepare my witness statement and the big day... is it wrong to be excited !? lol
Thanks everyone.0 -
You coudl get going on the WS now
No need to wait. It needs doing, and means you have time to fine tune it.0 -

Hope all is going well.0 -
Hi All,
Hope everyone had a good Christmas and New Year.
I've put this to the back of my mind over the break but time to get back to it now so am busy collecting evidence and writing the witness statement which will be posted in a couple of days. After reviewing everything I have noticed a mistake to do with dates (namely stating the ticket was issued on a Saturday when it was actually a Friday) within the defence, could this have any impact on the case?
I dont know how this managed to slip through to be honest but it has...
Cheers all.0 -
Hi All,
Left this a bit late (deadline for submission of WS and evidence is Thurs 25th) however I feel I have gathered some solid evidence and thus my WS is quite light but straight to the point. Can any one advise on what other evidence I need to include? I need to get the transcripts from the Parking Control Management UK Ltd VS Bull case B4GF26K6 to include, does anybody have these to save me applying via the EX107 form ?
Please see below and supporting evidence:
Witness Statement
I, xxx xxxxxx live at 5xxxxxxxx, xxxxxxxx and am the Defendent in this case. I make this statement in support of my defence and refute UK Car Park Managements claim that I should pay a Parking Charge Notice (and ensuing costs) for parking my motorbike on xxxxx xxxx in xxxxx on xxx xxxxxxx 2018. This statement is true to the best of my knowledge and belief.
1. On xxxxxx 2017 at approximately 6:30PM, my motorcycle was left outside of the xxxxx & xxxxx shop on xxxxxxx xxxxxxx. There were other vehicles parked outside this property and to my left side between where my motorcycle was left and the property a vehicle similar to a Land Rover/Range Rover Evoque was parked. This vehicle completely blocked my view of any signage relating to the land. Please refer to evidence P1 and P2 to see where my motorcycle was left and evidence of a vehicle similar to that stated blocking the sign.
2. After receiving a parking ticket in the post (no ticket was left on my motorcycle), I proceeded to go back to the where I left my motorcycle to read the sign in greater detail. I discovered that the sign states:
- Permits must always be displayed in windscreen at all times.
- No parking outside of a designated area/parking bay.
My motorcycle does not have a windscreen so I would not have been able to display a permit even if I had one. Furthermore, I proceeded to check vehicles parked on this premises for ‘Valid Permits’ and was unable to find any. Please refer to evidence P3 and P4.
There is nowhere on the premises to be able to get a parking permit nor are any details around how to obtain one displayed.
There are clearly no bays or designated parking areas outside of the property. Please refer to evidence P1.
3. I firmly believe the signs erected on this property do not meet legal requirements for size and height. There are two parking signs on display at the property and I have evidence of both being blocked by vehicles on separate occasions. Please refer to P2, P4 and P5. The signs displayed to do not stand taller than 5ft from floor to top of the sign.
4. Once obtaining my initial evidence I ignored the bombardment of PCN’s received in the post followed by increasingly threatening and more constant Debt Recovery Plus demands which seemed to increase unconscionably every time a letter was received.
5. I believe the facts stated in this witness statement are true.
Evidence:

P2: hxxps://ibb.co/pdjN9mN
P3: hxxps://ibb.co/tz8LKWY
P4: hxxps://ibb.co/P5DKC7C
P5: hxxps://ibb.co/k3w9x7M
Thanks all and sorry for being so last minute, a hasty reply would be so very much appreciated !0 -
