    What is the correct email to submit the defence to and with what title?

    I remember seeing it somewhere but cannot seem to find now and I do not want to enter into the online input box through moneyclaim as it ruins the format.

    It's in the NEWBIES FAQ sticky, post #2, I believe.

    Yes, I too am sure you read it somewhere.

    You now have precisely twenty minutes to file your Defence.

    Defence has been filed.

    Quick update - I recieved a letter in the post confirming receipt of my defence and the money claim online portal also shows this information.

    I have not yet recieved any further communication or documents, is this normal? Or a good or a bad thing or does it just take some time?

    Perfectly normal.

    The CCBC sends a copy of the Defence to the Claimant and the Claimant then has fourteen days to decide whether or not they want to continue with the claim.

    Hi All,

    So I have finally recieved some communication back along with the N180 Directions Questionnaire. The email recieved from Gladstones read:

    "We act for the Claimant and have notified the Court of our Client’s intention to proceed with the claim.

    Please find attached a copy of our Client’s completed Directions Questionnaire, which will be filed with the court upon their request. You will note we intend to request a special direction that the case be dealt with on the papers and without the need for an oral hearing

    This request is sought simply because the matter is in our Client’s opinion relatively straightforward and the costs incurred by both parties for attending an oral hearing would be disproportionate.

    You will note our Client has elected not to mediate. Its decision is not meant to be in any way obstructive and is based purely on experience, as mediation has rarely proven beneficial in these types of cases. Notwithstanding this, our Client would be happy to listen to any genuine payment proposals that you wish to put forward."


    Seems maybe some slight scare tactics there ?

    I am now going to follow the Court Claim Procedure (updated October 2016) by Bargepole referring to point number 4. As mentioned Gladstones have requested for 'Special Directions' so I will be opposing with the text “The Defendant opposes the Claimant’s request for special directions, and requests that the case be listed for an oral hearing at the defendant’s home court, pursuant to CPR 26.2A(3)”.

    Does all of the above seem correct ?

    The usual advice is indeed to object to the case being dealt with on the papers.

    I did want to check though that you are willing to attend court to defend the claim. It is nowhere near as bad as it sounds (did one a couple of years ago for my mother and won!). Think more along the lines of a job interview than the wigs and gowns you see on TV!

    Yes, that letter is the usual template crap. Not scary.
