    Sorry, What is the 30-day deadline and how should I word it.

    WHen you respond to a LBA they have 30 days to get the documents you require OR to explain why they *cannot*

    That deadline keeps ticking.

    Shouldn't it be the 30day deadline stops because they havent perofrmed the apprporiate diligence before serving the LBA.

    bw Legal sent a letter of claim dated 2nd July 2018 giving my son until the 6th August 2018 to pay or respond to the claim. He responded on 6th August and asked for all the paperwork they had. They sent some but not everything that is when he got back to them on 17th August and we have there reply above. Has the 30 days expired?

    From the PRE-ACTION PROTOCOL FOR DEBT CLAIMS:
    5 DISCLOSURE OF DOCUMENTS
    5.2
    If the debtor requests a document or information, the creditor must –
    (a) provide the document or information; or
    (b) explain why the document or information is unavailable,
    within 30 days of receipt of the request.

    My son first asked for all the paperwork during a phone conversation on Aug 6th 2018 they sent paperwork with a letter dated 10th Aug 2018. That didn't contain all the info as they did not supply a copy of the appeal that led to the rejection letter being issued point 6 of the email dated 20th August. Also PPS did not send a POPLA reference no so we could appeal their rejection of the appeal. So the 30 days would have started on 6th August when he asked for the paperwork?

    The deadline is on THEM to provide the documents

    It started 2 working days (if by post) from the 6th August, or by 6th as it was on the phone.
    That deadline of course has not expired. But the clock keeps runnig. They have 30 days from the 6th.

    You mentioned reminding them of the 30 days not stopping post 41 is this ok.
    Thank you for your reply I would just remind you that The 30-day deadline which began on the 6th August 2018 When I requested all the paperwork you had regarding this matter does not stop just because you haven't performed the appropriate diligence before serving the LBA. Failure to meet these obligations will result in a complaint to the SRA.
