You may have done this already, but you can send a SAR under the GDPR though, if you want data/photos/copies of letters from Excel.
The GDPR applies to all companies/data processors - albeit there is one aggressive idiot I know who seems to think he can use it to threaten individuals, hahaha...guess who, regulars?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

if you watch the feb 02 2018 debate in the Houses of parliament and the recent july MP debate in the committee rooms, you would know about their frustration at getting no responses from parking companies
why do you think Sir Greg Knight has introduced a BILL to parliament that will include mandatory resppnses we believe
not one MP dissented in either of the 3 yimes its been debated so far (the first was july 2017)
if you are going to reply to this MP, dont give them any more fob off ammunition , and get them to support the new bill, because nothing will change before that bill becomes law when the queen nods her head
meanwhile, do the SAR route and make life hell for Excel0 -
Thanks for the replies Redx and CM, I have got a previous letter of my MP stating that he does support Sir Greg with his members bill as I said at least he has the courtesy to reply to me even if my letter/s to him are a bit clumsy!!
I think the question that is mulling around in my head is since it has been proved (on here recently) that my PCN is not POFA compliant do I really have to jump through hoops and eventually prove it in court that they need the driver and cannot hold me RK liable, why would Excel not admit their failing/s and alter their strategy??? I can only assume they are having much more success with people crumbling and paying.
I will most certainly send the SAR off to Excel, anyone have the link for it?0 -
its their job to prove that they have taken the correct person to court for an alleged debt and that the person there is the person who is liable and owes the money
not just about parking issues, it could be a plumber stating he hasnt been paid for installing your new boiler (so its not about parking per se) - if somebody wishes to take you to court and sue you, thay can do so, for any reason , if they fill in the MCOL and pay the court fees
its clear they play the numbers game and the threat of court frightens most people , somebody recently posted a summary on one thread here about it, so find it and read it

Thanks for the link Redx, looks pretty straightforward to do and I definitely know how the small claims courts work, your example about the plumber being a good one.
I absolutely agree with your statement of them playing "the numbers game" oh how I wish EVERYBODY appealed or better still chose the Court option, the whole system would grind to a halt then the Government really would have to step in with some fast legislation!!
Anyway thanks to ALL the regulars on here I'm learning more everyday and even how to reply myself to a few newbies, lol.0 -
Hi Regulars, just a very quick update.
I haven't posted for a while regarding my PCN as I've nothing to do at present but I wanted you all to know I'm still reading lots and learning more everyday I may or may not need to post a court defence in the future but I will be more than ready for sure, we will see if one comes.
I have posted a few replies to newbies but I'm not educated enough yet to give correct advice so I'm reluctant to post to others at the moment.
I have recently received my first Zenith letter lol, its just so predictable isn't it but all I wanted to say is keep up the good work regulars, it really is appreciated.0
