Repeat what??, not sure I,m with you0 -
Day after the issue date is NOT compliant. It is day after the notice is given, which is AT LEAST 2 working days after posting.0
-
Apologies - I missed that in the small print of the scan. CM and Nos are right, non-compliant, you'll ultimately have to persuade a Judge on it though. It won't shake Excel off at this stage. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Ahh right I see, thank you people.
So my PCN says "that if, after the period of 28 days beginning with the day after the issue date of this notice" etc etc and that is not POFA compliant?
I understand a lot more than I did 6 months ago but its helping me to learn more and so this non POFA compliance will form part of my defence if it goes that far.
You see I didn't understand 6 months ago ago why I would put "signage" in my defence, I am the RK I haven't drove in there but as ive learnt there are many points to a defence and I'm guessing put everything in there so long as its relevant to my case of course.
Thanks again for checking my PCN I will look into how I can upload bigger pictures now (should I need to)0 -
Yes that is utterly noncompliant. It robs you of a MINIMUM of a day, and sometimes a LOT more.0
-
Why ask if it is non compliant?
My post already told you it isn't - could we please not repeat this all over again.
It's unfair to expect us to repeat what's already all over other Excel threads that you could have found in less than the time it took you to type that reply.
To save our sanity, please search the forum and find it said before on Excel threads.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thank you Nosferatu.
I'm making an assumption here so please don't shout at me. Is it worth writing to them pointing out that any court action would be a waste of mine, theirs and more importantly court time as they cannot pursue me as RK (I know they don't have to use POFA 2012 in any proceedings) but anything that makes them re-think a LBCCC is maybe worth a try?.
Or am I miles off the mark here and wasting more of my own time, instead just respond with the non-compliant POFA at LBA stage, I know Excel are extremely stubborn and quite litigious.
Any thoughts??0 -
You might be wasting your time but I think writing now looks more reasonable when you show a Judge later, the efforts you made to deal with the dispute.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Fair point CM, but if I may I did read somewhere that Excel have sharpened up on their PCN,s and so I was wanting confirmation.
Believe me I'm trying to keep posts to a minimum and reading everything, everywhere. I've only replied to your post now out of courtesy to you, I've read A LOT of your posts/replies and they've given me a massive heads up with all this PCN aggro so thank you for that.0
